Ted Nugent will plead guilty to illegal black bear hunt

By Kim Murphy

4:53 PM PDT, April 20, 2012

SEATTLE -- Just when they thought Ted Nugent didn’t have any more arrows to unleash, it turns out he did: specifically, an arrow aimed at a bear during a hunting trip in southeastern Alaska that has now landed the rocker-turned-outdoorsman in federal court.

In a plea agreement filed Friday in U.S. District Court in Anchorage, Nugent will plead guilty to one count of transporting an illegally hunted bear — an offense that could result in a $10,000 fine.

Nugent, 63, was on Alaska’s Sukkwan Island in May 2009 filming an episode of his Outdoor Channel television show, “Ted Nugent Spirit of the Wild,” which is described on his website as the “ultimate hands-on conservation lifestyle television show.” According to court documents, he was bow hunting near a bait station designed to attract black bears when he fired an arrow that wounded a bear, which then ran off.

Nugent “failed to locate and harvest the wounded black bear,” the plea agreement said, and then four days later, he shot and killed another black bear at one of the registered bait sites and then transported it off the island.

The problem: Alaska hunting regulations say the first wounded bear fulfilled his bag limit; the second one was an illegal kill. Transporting it off the island made it a violation of the federal Lacey Act.

Nugent has been in the news over remarks he made at the National Rifle Assn. convention earlier this month in which he called the Obama administration “vile, evil and America-hating” and invited the president to suck on his machine gun.

“If Barack Obama becomes the president in November, again, I will either be dead or in jail by this time next year,” Nugent predicted at the convention.

The plea agreement filed Friday — the same day as the criminal charges — doesn’t call for jail time, though the count he’s pleading to theoretically carries a penalty of up to a year in prison and a $100,000 fine.

Instead, prosecutors will recommend two years of probation, a prohibition on hunting and fishing in Alaska and on any U.S. Forest Service lands for one year and a fine of $10,000. The agreement also calls for Nugent to create a public service announcement to air every other week on “Ted Nugent Spirit of the Wild” for a year emphasizing the importance of hunters being familiar with the regulations in areas where they hunt.

A judge has to approve the sentencing recommendation during a hearing set for Tuesday, at which Nugent will appear by telephone.

Nugent’s attorney, Wayne Anthony Ross, is a longtime gun rights activist who twice ran for the Republican gubernatorial nomination in Alaska. He did not return telephone calls or emails Friday, but he told the Anchorage Daily News that the arrow only grazed the first bear and it scampered off.

“They've got apparently some crazy law in Southeast [Alaska] that says if you even touch an animal with an arrow, it becomes your animal,” Ross told the paper. “He looked to see if he had hit it and didn't believe that he'd hit it fatally.

As a hunter and lover of firearms, I'd prefer that Ted Nugent eat shit and die.

I respectfully disagree. "A bear with your arrow in it counts toward your bag limit" seems like a rule you aught to know to hunt that location. Prevents people like Ted from putting arrows in every bear they come across until they put one down they don't have to track.

but if it's as his lawyer's statement says and the arrow just touched the bear and there wasn't any evidence that the bear was wounded...

how is said arrow "in" said bear.... and how did they even know that he "shot" said bear?

10-1 says someone, maybe a viewer on a tape, maybe a guide, maybe someone else "thinks" he shot said first bear, and Ted was not in fact "Innocent until proven guilty"

Re: Ted Nugent plead guilty to illegal bear hunt

I wholeheartedly agree with the last two posts.
This guy has let his ego supersede ethical hunting and a sense of responsibility.
I hope one of the animals he wounds turns around and mauls him some day.
The only episode of his show I saw he was hunting in a fence and still managed to take a marginal shot on an animal he let run off.
I recall he relied on someone else to retrieve it while he napped.

AGREE...
this guy does more and donates more in a year than any of us make, to organizations that allow us to continue with the "Hunting" and "Shooting" we love... while I don't like seeing animals stuck in guts or ass with a serrated stinger, sometimes it happens... @ least he has the balls to say what most don't, and has the ability to get everyone in the U.S. to hear it... plain and simply, I'm glad he's on my side, that's for damn sure... who else would you rather listen to, ed shultz???

Re: Ted Nugent plead guilty to illegal bear hunt

Where's the bear? Who reported it? If this happened in 2009, why are the charges being brought up now? Coincidence?

I guess someone actually watched one of his shows.

Re: Ted Nugent plead guilty to illegal bear hunt

Do you all think this would have come out if he didn't make the statements about the president? This isn't a excuse for the infraction on a bear hunt.
Does Ted come across a little blatent sometimes? Sure he does, he has done much more for hunting and gunrights than most ever will.
Something to consider, Ted hunts all the time and this is the only unlawful thing they can come up with.

"It's not the first time Nugent has run afoul of hunting laws because of his TV show.

According to the Los Angeles Times, Nugent pleaded no contest in 2010 to California charges of baiting a deer in 2009 and having an improperly signed hunting tag.

A spokesman for the California Department of Fish and Game apparently saw an episode of "Spirit of the Wild" and told the Appeal-Democrat, a newspaper serving California's Sutter and Yuba counties, that he "just about fell out of his chair" when he saw Nugent shoot and kill an immature buck. An investigation found that Nugent had used an illegal chemical scent to attract the deer, the Times reported. A charge of shooting an underage buck was dropped. Nugent lost the privilege to hunt deer in California until June 2012."

Re: Ted Nugent plead guilty to illegal bear hunt

No different than any of the other TV "pro" hunters.

If I see one more hillbilly, goatee'd shmuck on tv make a piss poor hit on a damn deer and than whoop and holler like an idiot about the "great" shot they just made (because they obviously think we're either blind or stupid and dont know a poor shot when we see it), but than wait till morning to "recover" it (no doubt with dogs and a rifle) ill puke!

TV "hunters" are the WORST! The only one I can stand to watch anymore is Shockey.

Well, it's just another case of the media trying to discredit a great, real American patriot. They took the cue from his comments at the NRA convention and are now resurrecting old news. Ya gotta love Ted for telling it like it is vs some of the Bamster cunts on this website.

I think that Ted has done alot for hunting and for gun rights. Undoubtedly his personalty may not work for everyone. But is he has a hunting show he better damn well know the law and regulations where he is hunting and abide by them.

He also has a tendency to take liberties with the truth.

"Nugent, who was rejected by a draft board during the Vietnam War, claimed in a July 25, 2011 interview with Military.com that he has trained with the Navy Seals, Green Berets and Army Rangers in both an official and unofficial capacity since the late 1970s. And then he came to SD to hunt pheasant in the southwestern part of the state around Edgemont etc. He claimed he had no game violations recently anywhere!!! Then it was found out about the CA deal and that he had indeed lied about no prior convictions etc. IIRC SD finally dropped the charges but I think he made some 'donations' to a couple of organizations for that dismissile? I think CA kinda soothed things over that he had made a mistake, plead guilty etc so SD basically let him off also, am sure because the state didn't want any 'bad publicity'?

Now I am kind of a Ted fan but them series of 'incidents' kinda turned me off. Still think more of him and what he stands for then most of these POS celebrities though! Actually the summer of 2010 I had sent him a 'free hunt' invitation for him and a couple of friends to hunt the family farm here south of town for pheasant as we had literally hundreds. Was notified that he would consider it but had numerous hunts/places to be that fall. Well, he nor staff never called back and after hearing other encounters that fall with G&F here and CA I was kinda thankfull it didn't work out for him!

Re: Ted Nugent plead guilty to illegal bear hunt

Though I support his words, it's his method of delivery that turns people off. I'm sure he likes the attention it gets him.

Re: Ted Nugent plead guilty to illegal bear hunt

Hunting is like driving. If a cop follows you for five miles at some point he is going to find a reason to pull you over if that's his goal. No matter how ethically or morally pure we think we are at some point we all break the law.

If I was in Alaska shot a bear thought it was a miss, made a solid effort to find blood etc. and found none, you're damn straight I'm shooting another.

Re: Ted Nugent plead guilty to illegal bear hunt

Yes, I agree with 762, the world needs more of people like Uncle Ted. Some of his hunting ethics I don't agree with. He speaks his mind, and that I like. Like he says, if you cannot speak English, Get the FUCK OUT.

The Bear thing, I don't agree with. If he shot it, Put more effort in to recovering the bear and make sure it don't suffer.
If he is found in the wrong, just give him the fine and be done with it, Then vote him into office.
His music, I Love. I will go to every concert he brings here.
He is a great writer. I have two of his books, God Guns and Rock n Roll, and kill it and grill it. The cook book has great recipes.

I think it wouldn't have come out if he had obeyed the game laws of the state of Alaska.

His guilty plea was entered on April 14th, so was likely charged well before then.
His moronic rant at the NRA convention was last weekend.

Re: Ted Nugent plead guilty to illegal bear hunt

Like him, hate him, don't care. Bottom line here, the state made an accusation, he manned up, pled guilty. Gonna pay the fine, and do the time issued to him. Not plea out of the offense. He did the same thing in Cali.
He may have f'#up, and I do agree that if you are gonna hunt, it is up to you as the hunter to know and comply with the laws.
I honestly do not think that any of these TV hunter morons do any of their own discovery work prior to their hunt.
Get busted doin wrong, Do the right thing. He did.

Re: Ted Nugent plead guilty to illegal bear hunt

Don't give two shits about Ted however, most outfitters stop the hunt once you connect on an animal and recovery becomes top priority. No mulligans in this game, bad shots are on the arrow slinger or trigger puller.

Re: Ted Nugent plead guilty to illegal bear hunt

If you fart in the woods, odds are you break a hunting law.

I agree 100% with this:

"Hunting is like driving. If a cop follows you for five miles at some point he is going to find a reason to pull you over if that's his goal. No matter how ethically or morally pure we think we are at some point we all break the law."

I once got a ticket from a game warden for "disturbing a lawful hunt" for riding a four wheeler down the logging road at my own home. I wadded up the ticket and threw it on the ground and told the warden to fuck himself. Somehow, the prosecutor didn't want to take up the case.

At the same time, I couldn't tell you how many times I've been pulled over by hot-head cops hoping to give somebody a DUI late at night. They always have the same excuse, "you crossed the center line". One of these boneheads even told me that on a county road where there was no line.

Frankly, Nugent does more good than bad. When anybody spends as many days afield as the guy does, the limits will be pressed and every hot-headed game warden wants to be the guy that nails the celebrity. Frankly, if there was no evidence of sticking the arrow in the bear, I can't say that I'd have done anything differently. A graze that doesn't penetrate the animal that offers no blood trail is a miss. And an "improperly signed hunting permit"? Are kidding me?

Re: Ted Nugent plead guilty to illegal bear hunt

I think ol' Uncle Ted is a crazy ass dude. I don't think he represents conservatives very well, though he can give a rousing speech to the base. The draft-dodging thing bothers me, and especially because he took that duty to serve so lightly, and then says "well, I would have been awesome at it anyway." Being casual about serving your country in a time of war demonstrates a serious character flaw.

I wouldn't have Uncle Ted as a hunting partner either because I think he'd get the whole hunting party arrested. He's demonstrated some bad judgment in the past that he's admitted to. I can only imagine some of the shit he's pulled in the woods that he hasn't gotten caught doing... "Hey y'all, watch this!"

But.... I like his music. "Cat Scratch Fever" is a hell of a song.

indeed.
it is estimated that the average american commits 3 felonies a day without even knowing it.

i think any person who hunts more than 1 day a year has broken numerous wildlife laws and probably didnt even know it

Bongfulls of herb?

Gallons of whiskey?

We should be proud that someone who should be dead, is a pro-gun advocate..

Re: Ted Nugent plead guilty to illegal bear hunt

Did anyone hear Ted on Beck today? If half of what he said is true he is being singled out by the feds.

He said on record during the court proceedings that he had never heard of the law, and he deals with law enforcement and wild game enforcement all the time.

My attorney has been a lifetime licensed guide and outfitter in Alaska, a lifetime hunter in Alaska. He never heard of the law. That notwithstanding, I have by all information been the first and only person ever charged with this. The State of Alaska was not interested in charging me, but the federal government was.

NUGENT: Well, I ‑‑ the bear hunt in question took place with my sons in the Prince of Wales Island in 2009. Remember, Glenn, I’ve been hunting in Alaska since 1977 and the law has always been the same, that when you take possession of your animal, you apply your tag. That’s the universal law.

NUGENT: It really is. And I’ve got to tell you, they gave me the ultimatum the day after I endorsed Mitt Romney and this has been ongoing now in the California, I’ve got to tell you the California no‑contest plea I gave, I’m going to write a piece that’s going to tell you about the horror story, the unprecedented horror story. Once again the U.S. Fish and Wildlife service.

Now, if some U.S. Fish and Wildlife service are getting angry at me, that would be guilt, you’re guilty of corruption and abuse of power. I’m not talking about good agents. I’m not talking about agents who abide by their oath to the U.S. Constitution and follow the letter of the law, including the Fourth Amendment. I’m talking about jackbooted thugs who are kicking down doors predawn, guns drawn over a charge that there might have been, quote, feed within 450 yards of my tree stand bow hunting for deer in California, Glenn.

NUGENT: Felony. The Lasiak was first designed many years ago to stop the illegal importation of endangered species. I supported it 100%. But now the Lasiak is being used to charge innocent young men and women who abided by every game law ‑‑ get this ‑‑ for shooting a deer with all the right licenses during the right season with the right equipment but because they used the wrong broad head, a broad head, by the way, which is the number one selling broad head on planet Earth that is legal everywhere except two states and they shoot their deer, proper licenses, proper tags, bring it home and they’re charged with felonies equal to armed robbery and rape and murder.

I don't know what broad head it is that it's a felony to hunt with but I want some.

I heard most of it. I think GB said there was going to be more on this tonight. Unfortunately, I don't subscribe to his show.

That would beat his old record by some 49.9%.

Re: Ted Nugent plead guilty to illegal bear hunt

Big brother doesn't like it when you call'em on there shit. retaliation??????sounds like it was to me?? Ted for President!

Re: Ted Nugent plead guilty to illegal bear hunt

I can't pass judgement on Uncle Ted. He is what he is, and does not appear to make any bones about it. That probably paints a big bullseye one him for some folks. We come from different places, and hold some different views, but I am personally very glad he's on our side. I'd think twice before doing anything to change that.

Re: Ted Nugent plead guilty to illegal bear hunt

So basically here's what happened, according to Nugent & Beck.

1. The Feds, using their time machine, crystal ball, or whatever, foretold that Nugent would
A: Come to Alaska to hunt
B: Wound a bear
C: Shoot and kill a second bear
and most importantly
D: Mouth off about the POTUS, some 2-3 YEARS AFTER doing all of the above.

So they set their trap and waited...

But to cover themselves, they went ahead and published the new law in advance of Nugent's hunting trip.
They even were so brazen as to highlight the regulations in their publication, knowing (from the crystal ball, of course) that Nugent wouldn't bother reading them.

Yep. They set him up big time.

Re: Ted Nugent plead guilty to illegal bear hunt

amazing how many people won't debate him. his persona may leave a little to be desired, but never underestimate him. my wife shot with him years ago and got video. what a riot. very funny and quit wit. God bless Ted

Re: Ted Nugent plead guilty to illegal bear hunt

Just rationalizing in the Beck frame of mind.
