I'd be curious to see any video footage available of the incident. I'd want to see if the Mgr. was "under reasonable and imminent threat of death or great bodily harm." I want to see on what legal basis the prosecutor is charging the manager. Then again, this is Illinois, an anti--gun state so I can see the shooter being charged even if it was a "valid" SD claim. Are they being charged for just having an invalid and unegistered weapon, or are they being charged for the shoot itself?
Illinois, so the manager in this story may have been committing a crime by having a gun, or by having it somewhere she was not allowed to have it.
If someone is robbing a bank (committing the crime of bank robbery) and a security guard or customer attacks them, it is not self defence under the law when they shoot that person.
So today Democrat prosecutors often stretch that rule to punish what should be lawful self defence. Better to be tried by 12 than carried by 6.
But if the bank robber is making furtive movements towards the security guard and/or pointing the gun at them, can they still be charged for responding to those movements?
