So last year I had a trust drawn up and got a 9mm can on it. I have a new 308 sitting in my class 3 dealers waiting for me to go fill out the form 4. My adviser isn't available to help me get this figured out the rest of the way, this time around.

My trust is sitting in a safe, and I haven't written in the first can on schedule list yet.

What should I do next? Bring with me to the Class 3 dealer tomorrow? Anything else different the 2nd time around?

Re: 2nd can on a trust

Bring a copy of your original trust, and the addendum page (Appendix A, usually), with TODAY's date and the new can listed after the other can.

The trust, once signed and notarized is the legal entity. It has a "birthdate."

The Appendix lists the new stuff. Your signature goes on this form. You don't need it notarized every time. As grantor and trustee you're the guy who controls what goes into the trust.

Export the Trust to word document and you can modify form A anytime you would like to add new item into your Trust. Only print out the form A, sign and date it.

Re: 2nd can on a trust

I created a copy of my Schedule A on a Word document and emailed it to myself so it's always on my phone and can be updated when I add or sell stuff

Create the document (schedule A)
Add the existing items in order received

Send a "complete copy" of trust with NEW form 4 with that other form verifying you are YOU and $200 tax then WAIT

So I don't need to resend the entire trust again? I'll be sending just form A with the older can and the newer (potential) one on it. Make sure it is signed by each item? </div></div>

No, you will need to resend the whole Trust to ATF for 2nd can. What we are talking about is that you don't need to recreate your Trust. You just need to update your Form A and sign and date your Form A.

Is this correct? I was always under the impression that you didn't list the can on the trust until your approved form 4 came back. It can't technically be in your trust until the ATF approves the transfer can it?

Jason, I think you're right, since I didn't put the first one on the trust when it was sent in th the ATF, I don't plan on doing anything different this go around.

Re: 2nd can on a trust

I was advised differently -- I was told to list it so that the BATF could see that it is in the trust. The person who advised me said that the ones that dont have them listed are the ones he gets calls on (not all but some) but he never gets calls from the BATF on the ones that have them already listed.

He also said that technically you do own the suppressor you are not allowed to possess the suppressor so you can still place it in your trust. Yes it is a gray area.
