Suppressors Form 4 or Form 1

I'm making a SBR from parts, the Class 3 people on both sided tell me to use a Form 1 or a Form 4.

Use a Form 1 if being assembled from parts

Use a Form 4 if buying completely assembled upper.

An I correct in this assumption? There is not lit either side in this debate from BATF.

Forum 1, if you are making the SBR, from parts or a complete upper. Form 4 if you are buying a complete SBR, such as one made in the Colt factory.

If you put the gun together, you are the manufacturer of the SBR, even if it's just pinning on a short barreled upper. As a manufacturer you are required to engrave the lower with your information, as per ATF regs. If someone else makes it, such as Colt, their info is already on the receiver, and it is already registered as a SBR.

Yes, you are correct. Form 1 since you're not buying it complete. As DM said, simply mating an upper & lower constitutes manufacturing as far as NFA is concerned.

These guys know their stuff. If your going to buy a short upper to put on a lower you already own. you need to form 1 your lower.

If you buy a lower that has a short upper on it already, its already an SBR and whoever did that originally should have done a form 1. Then if you buy it, its transferred on a form 4.

form 1 - is for making new stuff or assembling parts into firearms that will be NFA, eg SBR, SBS, silencers etc.

Form 4 - transfers existing NFA items - Assembled SBR's, SBS, silencers.

That is great but if that is your upper and lower you need to keep them apart (far apart) for you can be guilty of "constructive intent". I know people will jump on me for this but better safe than sorry.

Ya theoretically you should have a pistol marked lower to be legal. just make sure your forms get sent out. To be safe you could just keep the upper at a friends house or something, but if the ATF shows up at your house, like most people would say, you have other issues at that point. hahaa.

I'm sure this question has been asked before somewhere on this vast forum but, is registering a SBR the same $200.00 tax stamp on a Form 1 as on a Form 4?

My last 2 form 1's that i filed in march only took 2.5 months door to door. thats pretty good. results do vary. I always send a money order and usea trust. so far everything has taken me 3 months or less. And i have done 5 transfers this year.
