Join contest SubscribeAside from not having a way better than money, the economic losses involved are significant. At sentencing for the man who attempted to murder a friend of mine the court ordered $3m in restitution for actual economic damages projected as a result of her injuries, which have cost the government something like $2m in medical expenses for a total of $5m. Depending on the education of the decedent in the Dallas case (is he a CPA?) actual economic damages could reach into the lower edge of 8 figures.
Again, not true. Subpoenas are commonly used for investigation, before any charges are filed. You might have seen news reports of people urging Mueller to subpoena Trump.Until you’ve filed your case you will not be using a subpoena. Use FOIA or state equivalent instead.
You're ability to scroll back is identical to mine. You’d have to go back and get a quote for me.
I think serving coffee at 190* is negligent. That’s rare in home brewed coffee for a reason. You forgot (probably on purpose) to respond to point #2.
Didn't you want to give us your insight on training children not to grow up stupid and then do stupid things while blaming it on every one else?
I'd say I'm disappointed, but you did exactly what I expected of you.
You offered that money was the only answer because you fail to try and find a better way.
Then you went on about some personal crap to try and get me to forget about point #2.
It never works, but sometimes I just don't have the time, energy or inclination to ask you to try again.
I'm gonna go start dinner now. Be back later.
I look forward to your response.
I’m talking about civil subpoenas. You’re talking about criminal ones. Different deal from the scenario you’re talking about where somekneis trying to access files on investigations of shootings.Again, not true. But I care a lot less. You're ability to scroll back is identical to mine.
But I care a lot less.

That says volumes. If I was shown where I was wrong, I'd investigate to find my mistake and hopefully correct it.
But, then again I wouldn't go to a chef's forum and argue why a santoku was superior to a chef's knife, because I'm not knowledgeable enough in that area to argue with people who do it for a living.
If you knew what you were talking about you wouldn't have needed to call an attorney to check. After your poor showing I have no reason to believe I was wrong but if I get a chance I’ll look.
After 13 years on this forum you haven't noticed that a large portion of the members are curent and former military /police/government?But this isn’t a cop forum this is a precision shooting forum. And you don’t do this for a living. Not anymore at least. Did you leave voluntarily?
Pretty sure reasonable man standard still applies.
Mens rea is the concept you’re looking for. But he’s advocating requiring negligent shootings be prosecuted. So who decides what is negligent?
Oh I didn’t need to talk to her to know I was right. I’m just struggling with getting through your ego with facts. If you knew what you were talking about you wouldn't have needed to call an attorney to check.
After 13 years on this forum you haven't noticed that a large portion of the members are curent and former military /police/government?
You left out the part where you asked who determined negligence. To which I gave long accepted judicial rules. This was our exchange. I’m talking about negligence and you’re talking about the absence of negligence.
Oh I didn’t need to talk to her to know I was right. I’m just struggling with getting through your ego with facts.
Negligence and recklessness are, and have been covered by the reasonable man standard.
Any first year law student knows this.
Don't know why your trying to re-litigate long established law.
Are you a police officer or an attorney?
It will cost me lunch but I asked my lawyer to clarify.
Sadly?Manslaughter if she wasn't drunk, murder if she was drunk while carrying.
This is an "honest" mistake I could see certain thick headed people make. Large apartment complex, similar look on the outside or each apartment, absolutely adamant that you're at the right place, stranger opens "your" door, bang!
She may have a stand your grand case she could make. She could get off scot free. She'll be a target for vigilante justice (sadly) if she does.
Oh I didn’t need to talk to her to know I was right. I’m just struggling with getting through your ego with facts.
The Former Action Guy thing and $2 will get you a coke.
Did you leave that career voluntarily?
Yet posters in this thread want to throw out accepted judicial rules. You left out the part where you asked who determined negligence. To which I gave long accepted judicial rules.
So now that's twice you've been caught lying.
You gonna backpedal again and claim that's not what you really meant?
Your inability to follow does not make me a liar.Really?
Three lies and you're out.
Diversion #23, start insulting the person to detract from your lack of knowledge or to hide your ignorance or inability to answer basic questions.
Have we made it to page 7 yet?
Your inability to follow does not make me a liar.

Meanwhile, looks like Botham refused to follow instructions when the strange lady stepped in.
No reason or requirement for him to, when she had no right to be there.
I am not a fan of mob justice. Most are innocent, only a few are truly guilty. Court systems are a much better source of justice (but not perfect) then any mob.Sadly?
Better than no justice at all.
You mean the taxpayer and not even taken out of the departments budget? And the department is going to be on the hook for millions of dollars for it.
Lol you people are delusionalI'm not only questioning your sources I'm also questioning your reasoning.
I'll be as blunt as I possibly can because it seems you didn't understand my question the first time.
Who the hell do you think YOU are to judge which is a good police shooting and which is not?
Unless you are, or have been, a police officer I hardly give one fuck about your opinion on the subject.
Off topic and I hate attorneys but you should read up on hat coffee law suit and the reason it was so hot.Please. Attorneys are the problem.
Suing a company for millions because some klutz dumped hot coffee in her lap?
I have.Off topic and I hate attorneys but you should read up on hat coffee law suit and the reason it was so hot.
I make my tea with water right at the boiling point... but I do give it plenty of respect & care.
Wow!!
Mark a No Zone in your kitchen? TEACH YOUR CHILDREN. If you constantly keep the child away from any possible chance of learning, they will never learn.
The water from the faucet is hot, so TEACH little Susie which one is for hot and which is for cold.
Let them use it with your supervision until they are competent. It's like OJT.
Hi,
Verbal Commands!!!???
She was off duty right?
It was his apartment right?
So we have 1 person saying door was ajar and 5 saying they heard her knocking....
So story has gone from she got off elevator on wrong floor to she parked on wrong floor...implying no elevator usage needed because you enter building from the same level you park on.
Going to be interesting to see just how much and how many times her story changes because the witness statements being released publicly seem to be stable and consistent.
Sincerely,
Theis
I'm pretty sure the manager was serving overly hot coffee so people wouldn't have time to drink it and get free refills and had been warned by corporate not to do that more than once. It's been a while since I read that though. From the article:
Hot Water Causes Third Degree Burns…
…in 1 second at 156º
…in 2 seconds at 149º
…in 5 seconds at 140º
…in 15 seconds at 133º.
----
Third degree burns from 156° water in one second.
---
From the Liebeck case :
Liebeck's attorney argued that coffee should never be served hotter than 140 °F (60 °C), and that a number of other establishments served coffee at a substantially lower temperature than McDonald's. Liebeck's lawyers presented the jury with evidence that 180 °F (82 °C) coffee like that McDonald's served may produce third-degree burns (where skin grafting is necessary) in about 12 to 15 seconds. Lowering the temperature to 160 °F (71 °C) would increase the time for the coffee to produce such a burn to 20 seconds.
--------
Who to believe, a medical resource or a scummy lawyer and their clumsy client?
The high coffee temperature was a corporate directive to keep coffee hot for drivers.I'm pretty sure the manager was serving overly hot coffee so people wouldn't have time to drink it and get free refills and had been warned by corporate not to do that more than once. It's been a while since I read that though.
The most ridiculous thing about the coffee temperature is that coffee beans NEED at least 185* for coffee to brew properly and extract the flavor from the grounds.
Arguing that it should be served at 150* sounds like it's coming from people that don't drink coffee.
I guess we should set mandatory requirements on our ovens, stoves and BBQ grills so they don't exceed 150*.
Never mind that certain meats need 185* for proper cooking.
Try cooking that Digiornio pizza at 150.
Oh, I have another idea.
Let's make a law so that the outside temperature can't exceed 75*. That way the pavement won't get too hot and burn our little tootsies.
If we do that, then it will be safe to leave our kids and pets in the car while we go shopping.
Well then, I guess that means we will need to address freezing weather also. You know, frost bite and all...
Stupid people breed and create stupid children who then breed and create more stupid people.
We need to bring back dinosaurs so the stupid people can be eaten and removed from the gene pool.
The local news reported that the door was unlocked and I think it was stated that the door was open. I have also heard conflicting “ear witness” comments. The problem is that the only other witness is dead.

Hi,
@Maggot
And now the attorney for the victim has released a statement that says the victim purposely went out and bought the biggest and brightest red door mat he could find when he moved to that complex so that nobody was mistake his apartment for theirs........
First she had just finished a 12 hour shift but now the statement released by the Texas Rangers it states she had just finished a 15 hour shift.......care to guess where that is going lolol.
Sincerely,
Theis
@Mike Casselton
Coffee might be brewed at 190 degrees. It doesn't mean it's served at 190 degrees. Or even stored at 190 degrees. It's a simple concept.
WOW, I WOULD HAVE NEVER THOUGHT OF THAT. NO SHIT IT'S A SIMPLE CONCEPT. ANY TIME YOU TAKE ONE THING AT 190 DEGREES AND RUN IT THROUGH GROUNDS THAT ARE PROBABLY 70 DEGREES IT TRANSFERS SOME OF ITS HEAT. THE CONTAINER, THE CUP AND THE ACTION OF POURING THE COFFEE ALL REMOVE HEAT FROM IT.
Also different parts of your body will burn at different rates. Your fingers are probably more resilient than your old lady vagina.
WOW!! MORE INFO THAT I WOULD HAVE NEVER FIGURED OUT ON MY OWN.
BTW, NICE VEILED INSULT ON THE VAGINA THING.
She just wanted her medical costs covered but was awarded a lot more because it was procen that McDonalds knew that they had a problem with the temperature they were serving their coffee and ignored it.
THAT'S ON THE COMPANY BUT IT STILL DOESN'T EXCUSE THE STUPIDITY OF THE OLD LADY.
YOU DON'T SEEM TO BELIEVE THAT PEOPLE SHOULD BE RESPONSIBLE FOR THEMSELVES, AND THAT PUTTING A HOT CUP OF COFFEE IN YOUR CROTCH IS IRRESPONSIBLE AND NEGLIGENT TOWARDS SELF PRESERVATION.
YOUR VIEW IS THAT IT'S ALWAYS SOMEONE ELSE'S RESPONSIBILITY.
I don't even want to touch the original post. Someone correct me if I'm wrong...but a police officer breaks into my house, sees that I'm a big scary black guy, trys to give me orders, and then shoots me for not complying/being confused?
And then gets charged with manslaughter??? Like what the fuck?
I AGREE 100% ON THIS.
And the top minds of the Hide immediately color in the story in 5 pages that it was actually the liberal SJWs faults because reasons. Or that drugs were involved because...black people sell drugs? Or that it was a booty call gone bad?
