Only in Texas (that I'm aware of). It was night time (and, therefore, deadly force was authorized for a property crime). If this were FL, I believe the shooter would be charged with: 1) Use of deadly force in defense of property; 2) Manslaughter (she shot as the perp was fleeing... there was no apparent "threat of imminent death or great bodily harm").

South Carolina is also enlightened in night time lethal force in defense of property. Love this state.
