I have a friend thats and ATF agent and he sent me this today.

I believe if a Form 1 is approved as submitted (without additonal markings,etc) and if approved, would suffice. Here is the recent ruling that relates to your question about marking a SBR. ATF has ruled that additonal serial numbers, etc placed on firearms by every manufacturer in the process is counter productive to law enforcement needs. It talks about licensened manufactures, importeres, and a "non marking variance". They may not have addressed Form 1 requests, specifically. However, when one files a form 1 it is a request/approval to manufacture a specific firearm and contains all the markings to be on the firearm. The form 1 if approved would therefore, be valid and I would say be considered a variance from the "non marking" regulations.

-ATF has issued a ruling that authorizes licensed manufacturers who perform a manufacturing process on the firearms for, or on behalf of, another licensed manufacturer not to place their serial numbers and other required identification markings on the firearms, provided such firearms have already been marked as required and that all of the other requirements stated in the ruling have been met. This has no bearing on SBR's submitted on F1's. This is an opinion on marking requirments of FFL's doing contract work for other FFL's prior to the sale of the firearm. In other words, if you are an anodizer finishing AR lowers you no longer need to put your markings on the receiver provided a variance has been submitted and approved.


ETA: I don't think anything changes really cause subs have been doing variances for probably two or three years at this point.

If you are filing a Form 1, you need to engrave........otherwise buy a factory SBR to avoid additional.

A more rare unknown is see if the maker of your lower will SBR it for you, this also avoids additional markings.

Correct, there is the manufacturer of the receiver and the MAKER if SBR'ing. The MAKER still has to mark/engrave.

This has zero bearing on Class III stuff.

It refers to the extremely common subcontracting in the firearms industry. It's amazing how few people actually make the products they sell and how certain companies make everyone's stuff.

It actually asks you for the "Original Maker" as you are the new maker seeking approval. Basically if the gun is serialized they are saying no need to have another serial # as that can be used to track gun.

Do you have the means to make a barrel, receiver, or lower? No, and they know that as well, you are the intended person to make the firearms as in you are compiling the parts. You did not make that Rock River lower that you are building upon. So, you have to put that down... its helps in the description of firearm. You are required to engrave your full name and city/state in which the weapon is registered in. Or if you are on the trust your full trust name must be on the SBR receiver that holds the serial number in which you registered.

Its really not that complex.
