NICS delay

For the last 5 years every time I buy a new gun I get delayed , I still get the gun after 5 business days but what a PIA , anyone know what steps I need to take to remedy this , I do have a couple of arrest years ago , simple assault, nobody can take a ass whooping anymore without calling the cops evidently, and one weed possession charge way back in 1985, but until 5 years ago never had a problem.

ATF and FBI did not have an answer for me regarding this. FBI only told me a "UPIN" MIGHT solve my problem, but no guarantees.

I have been charged with possession of weed, but not convicted. Any and all other skirmishes were before my foray into this world.

It's been happening to me for about 8 years. No problems with my CWP; and ME is a state where having it doesn't nix the nics, so I've still got to do the paperwork.

Firearms at the FFL are usually returned within minutes. The real ass kicker is when I file a batch of F1. My last wait was 7 months; all while making those calls to the feds trying to figure it out, and my congress critter wondering why me.

No one has an answer. Im going to FOIA myself through both agencies and maybe that will give me some insight
 
Had the same problem. Was using a long time friend with his FFL. Being kind of an "anti-computer guy", he always
called in to the VASP. Turns out he was spelling my first name wrong for the last 35 years 😂
 
This started happening to me almost every time in the last 3-4 years and I have a clean record. Luckily the gun shops around here follow the Brady act and release them in 3 business days.

The wife has told me to just get my ccp, but I’d rather waste $150 on something like ammo.
You’d think your SSN would be good enough to identify you…
 
When I had a concealed permit I never had an issue. When I let it lapse and didn’t renew it , I was delayed twice , but got the weapons 3-4 days later.
I vowed to not go through the process again. Seeing as Arkansas is a Constitutional Carry state I’ll be packing regardless. If I travel state to state via my trucks , same same. I haven’t flown in years , Piss on em if they don’t like it. 🤨

My FFL told me they’ve seen a trend if you’ve been fingerprinted for a .gov job background they feel that triggers the delay. I’m always delayed. Usually about 2 hours. I can’t confirm the validity of this.
 
Florida has a 3 day wait on picking up guns too?

Yeah it is nuanced though. For long guns if you have a hunters safety course and hunting license you don’t have a wait. Concealed weapons holders don’t have to wait. Cops and service members don’t have to wait. But Florida isn’t one of the 15 states with an “alternative permit” scheme that satisfies the NICS check requirement, so everyone gets one of those it’s just done by the State’s law enforcement department (FDLE, one of about 25 different state agencies with law enforcement in their ranks).

Thanks for all the replys, looks like the UPIN might be my best option, main reason I'm asking is I'm considering getting a couple of suppressors and don't want any unnecessary delays , a CCW might help too but the same problem will probably rear its ugly head there also ,guess I'll find out ,but at least the current political climate is on my side.

I am a retired State Trooper, and I get delayed. Even while I was active duty I got delayed. I used to personally know a couple guys in the firearms services bureau and it didn't matter a bit. I learned to just go with the flow. Isn't worth the grief.

One way to find out. Buy the can.
 
UPIN is probably your only option since you’re beyond the point of making better decisions regarding breaking the law.

Wait till you get denied and have to deal with sending fingerprints etc.

I got my first delay last year, and have now been delayed three more times. Each time, it went through within 30 - 90 minutes... but since I live 32 miles away from the FFL, it is a PITA.

Was hoping it would go away with the current administration. Nope. 0 for 2 so far.
 
Concealed carry should let you skip the background check. Otherwise you could look into a UPIN.

State concealed carry has NOTHING to do with a NICS check. Some states are POC and do their own background investigation. Some deal with NICS instead of the dealer. Just depends on the state.

Its not uncommon. I used to get flagged and delayed every time I had an open security clearance investigation going on.

Other times delayed for no reason then in the last 5-6 years, I don't get delayed at all.

I think the only people who really know why and who gets delayed, are the ATF.
 
I’m a delay, always have been. Typically the full 5 days and then I just pick it up.

I got a CCL for probably 14 years, let it lapse because it doesn’t really matter anymore. Now I’m back to the constant 5 day delay. I also have suppressors etc with no issues from ATF, it’s just NICS.

I quit worrying about it finally, nothing I want can’t wait 5 days when I’m typically waiting months for an action or something anyway.

Well in my state, where I sell guns for a living, it does exempt the person from whatever background check is normally done. The person fills out the 4473 but the concealed carry permit exempts them from us submitting it. I shouldn't have generalized it since I don't know his state's laws but a CC permit does (in some states) exempt you from a background check.

That is exactly how it works here in Wyoming. No BGC with a permit. Just fill out the 4473, they file it there, and out the door…..
