True, but there is such a thing as implied consent. The hope is that no state would attempt to use it in such a fashion by intertwining it with a covid law or mandate. But there is Australia and they appear to have gone down that route, so...
IOW, just in the act of going to receive care, consent to be vaccinated would be implied for the good of the patient, other patients and caregivers no verbal or written acceptance needed if its law. Just put it on the paperwork that you don't read every time you go into the ER or clinic. I'm pretty sure that this is the position Australia's politicians would go to if cornered on it - making the victim the criminal and as a result the one who is responsible for the need to inject the vaccine in such a fashion to keep everyone else safe from him or her. Any untoward results from the vaccine would still be the patient's fault for going to receive medical care where consent is implied by walking through the door. See how easy it is to play this game?

Would be worth looking into. It doesn't fall under implied consent. If she had a sequelae it would be worth pursuing. I get how they are still pushing for more boosters and taxes, esp. after elections will see more.
With devastating reality of COVID policies, treatments (lack there of), forced treatments, altered data, vaccine side effects will become more and more apparent, more lawyers may be interested in pursuing.

Don't think so, but I'm not a lawyer. At least they shouldn't. An example of implied consent would be: near the appendix was a lesion that looked like cancer. If next of kin not immediately available in waiting area, implied consent could be to biopsy the suspicious lesion. It would be a stretch to justify a vaccination in someone who hasn't taken it voluntarily after a year.
