"He entered the property just moments after DiGeronimo was shot. An MTA officer, who lived nearby and also attended the scene, saw the plain-clothed Breitkopf with a handgun and assumed he was another suspect.

Breitkopf was shot in the face and was taken to Nassau University Medical Center, where he died of his injury about an hour later."

I would like to hear some more details on this, did he not identify himself as a po before he shot?

Something tells me the MTA officer didn't exactly execute the best judgement but that's what adrenaline does - I highly doubt the the victim and the perp were dressed the same...This is why one of the four basic rules of firearms is identify your target - the fact he was shot in the face was very disturbing to me though. An order to drop the weapon may have been appropriate but I'm not LEO so I don't know protocols. However, I do not this is why CCW carriers should not assume the guy with the gun is the bad guy... Regardless this is a horrible tragedy for both the family of Breitkopf and the officer that shot him..
