The most important take away from the story is that you should never voluntarily speak to law enforcement without a lawyer present or a grant of immunity. Since nearly everything on earth is in fact illegal, you will no doubt be guilty of something. Even worse, if you do not remember an event in the manner the FBI or any other secret police organization wants it to be "remembered", you get charged with lying.

Wait, let’s get this straight: Trump fires Comey following the recommendation of Deputy AG Rosenstein, who was essentially Acting AG after Sessions’ recusal, and thus the one calling the shots at DOJ (and by chain-of-command, the FBI as well). As a result of Trump following the advice of the acting-Head of the DOJ, they decide that’s a good reason to investigate him...because he followed THEIR recommendation. “He must be working for our enemy because he asked for our recommendation and acted on it.” Anyone else seeing a problem with this line of reasoning?

I talked to a prosecutor last week. He wants my client to be interviewed to "clarify" her prior statement. By "clarify" he means "add facts to support the prosecution's theory." The client's prior interview with the cops makes clear what happened and contradicts the prosecution's theory of the case.

I said that the client takes the 5th even though the client was not involved. Ohio vs. Reiner makes it clear that is the client's right.

The danger is that if the client testifies and sticks to telling what actually happened, the prosecutor can file perjury charges simply because he disagrees with her testimony. If the client changes her story and sings the song that the prosecutor wants to hear, then he will not file perjury charges.

So the end result is that in order to avoid perjury charges, the client is forced to commit perjury.

I am sure that happened in the Mueller investigation as well.
