One of my "neighbors" just went through this with a grizzly bear kill. Guy had shot a griz, conflicting stories on what happened. Got a divorce and wife used it, a federal offense, as blackmail, then after the divorce closed, she turned him in anyway.
The feds can only do what the states allow. States are pushing back and people like Kamala and Biden don’t like that. Just because a law is passed (or some lame ass unconstitutional regulation created by a fake lameasss alphabet agency) doesn’t make it constitutional. The 10th amendment still supersedes the bloated bullshit that gets passed in DC. An unjust law is no law at all. Nullification is how the war will be won.
It would be nice if that were true, or if it were true in reality, but in reality, as long as one molecule of steel, one screw in one machine, one part of a vehicle used to transport one part of something, the feds are going to claim that it is involved in interstate commerce, and they are going to win that claim, because all the precedent in the world says it is.
Of course on the interstate side I agree. But if nothing leaves state lines the feds have no power. The enumerated power is interstate not intrastate.
I think we agree. I am just cautioning that the feds will try to count the residue from your wok gloves as constituting interstate commerce. It's wrong, but that's how they roll.
Oh I know. They will do anything to make sure that they continue the slow transfer of all power to the fed. Eventually there will be no states. That’s the goal anyway for those that continue to ignore the constitution and the consequences. That’s why the states need to step up. Remind them that it’s the states that grant them the power and by that they can revoke it.

The federal government’s corruption nullifies federal law. States can choose to ignore tyrannical laws set forth by the feds. It should be more than pandering. I’m just waiting for a signature by the governor and the fine print.

That is the argument that has been used to justify all enlargements of the commerce clause. Pretty sure it will be used here, and all precedent is on the side of the feds. It could be as little as the machinery used to make the devices, as particle transfer is likely in most cases. And don't forget about the cutting oil. That shit is hard to get out 100%.

If that's the case, and I take your word for it, then either the TX legislature is dumber than average, or they wrote it knowing it would be easily overturned. My guess is both, but definitely the second.
