The primary purpose of my response was to point out that, AFAIK, no rights are lost without at least an appearance before and a ruling by a judge. I may have made a bad assumption that your phrasing implied permanent. No permanent loss without a judge.

As for the temporary part.

When you are arrested for ... whatever ... do they let you keep your gun in jail? You are temporarily "deprived" of any number rights while you're in custody. But, normally, in these cases you have actually committed some kind of crime to get the attention. However, most states (if not all) have statues or codes on the books that allow an officer to temporarily disarm a citizen who is being detained or arrested on reasonable suspicion or probable cause, warrant or no warrant. No rights "lost", temporarily "deprived".

As I said, I'm not a fan of red flag type laws mainly because they provide an avenue for detainment or arrest without any crime actually having been committed ... precrime.

While I'm not a fan of red flag laws because of this what I really don't like about some of them is they allow strangers to fink on you.
