Suppressors NFA Gun Trust??? Anyone have experiance with this?

Just learned about the NFA Gun Trust option for obtaining Class III weapons. Does anyone have any experiance with this method and any advice. i sent off for more info from a lawer in Houston but i am wondering how much the whole process will cost to obtain and maintain. any info would be greatly appretiated.

Also i tried the search function but could not find anything on the subject. if this is a dead subject i could use a link to the previous post.

The consensus is, that there is no consensus. Some have trusts with title ii weapons on them, others register as an individual. We've heard rumors of certain trusts being declared invalid by the ATF but nothing clear cut with official letterhead or signatures...

The safe route is to let a lawyer who specializes in NFA law and transfers handle it for you..although we hear of plenty of guys who use Legal Zoom or Quicken Willmaker to create their trust documents, and have their atf forms go through without a hitch.

All my NFA items are on a Trust. I created my Trust with Quicken Willmaker but then had a lawyer friend recommend a few changes.

Since you are in Texas I strongly encourage you to contact Bill Pace at Houston Armory. He can help you with the suppressor AND put you in contact with Sean Cody, a lawyer who works with H.A. and creates Trusts specific to NFA items. Sean is a personal friend of mine and will take good care of you.

I made a trust using Quicken. Works fine. The lowest price I have been quoted by a lawyer to make the trust was $600.

Thanks for all the info i live in harris county and the cheif law officer here will not sign off on the ATF paperwork so this just seems like the next best thing. i checked out sean cody's web site and sent off for more info and for them to call me.

Read the Quicken software before buying, I think 2010 edition removed the trust, you'll need to buy 2009 or earlier.

I went the NFA lawyer route for a trust. It was fairly simple but a bit pricey at about $600. I gave them the information they needed and who I wanted added to the trust. Once I got everything signed off all I had to do was choose the suppressors I wanted. I paid for the suppressors and sent everything to BATFE. The whole process from start to finish took about 6 months but that's mainly because I was in Iraq when I got the trust started. The trust took about a week, maybe 2 at most. It doesn't really cost anything to maintain unless you decide to add or remove people from your trust. Then it depends on what the lawyer charges for changes.

Confused by your question? Many will not sign off. Where I lived in Texas our Chief of Police would not sign but the Sheriff would. I have found the same where I am living now. In the town and county south of me, neither will sign off because they don't think anyone needs a suppressor.

my CLEO is signing everything. no hesitation. i was looking up the trusts and the local supressor seller said dont bother with a trust since the CLEO was signing. that was absolute. trusts are not in a sense. and with CLEO signing everything there was no chance of the revocation

I don't know if it's the same in your state, but if a cleo signs off. You also give them a right to go in your place whenever they want doesn't matter if they have a reason or not. Thats why I went the trust route+ only you and atf knows what you own

You do not lose any rights if the CLEO signs off.

CLEO will not sign off in Harris county becasue
1. The sheriff is notw a DIM
2. The Repub Sheriff was a FRETO
3. The Houston Chief is appointed by a DIM and is a DIM.
4. The judges do not want it used agasint them in a political race by the DIMS or the Judges are DIMS.

Trust are a great way to exercise your rights when your LEO is a dim wit or a commie. 10 years ago I bought a couple class 3 items, the Police Chief where I lived was a retired FBI agent, with a quick visit to his office he had was no problem verifing who I was a signed off, a true professional. I moved a couple years ago I moved to a different town, Bought a couple new toys the LEO in the new town was a total ass--le, refused to signoff and demanded a home visit. A simple letter from a lawyer dusted his limited ability brain off. Lawyer advised that a trust would a be good better tool to advoid contact with the dic--ead.

I had Bob J. Howell do my trust a couple of years ago. Bob is recognized as "the man" when it comes to NFA trusts and he charged me $400.

I didn't get a trust because the CLEO wouldn't sign off, but rather the time savings of not having to get fingerprinted, pictures and the sign off and the fact that my wife won't have to jump through any hoops if something happens to me.

My latest Form 4 was approved on June 16th, I'm just waiting on it to show up at the dealer now.

Exactly what I did. Had a lawyer in FL refer me to one in KY that handled my trust for me. They are far more convenient then having to track down your CLEO every time you want to send an item off to get approved. Done right, there are absolute. They are legal entities created for NFA items. Makes them pretty airtight.

If anyone needs a list of NFA Attorneys pick up a copy of Small Arms Review there is at least 5 top notch specialist in this field in every issue.Also if you have a LLC. or are an incorporated business you can file a corparate trust. Benefit of this is you can list other individuals other than yourself as trust holders so they can have the units in their possesion for use. Just make sure they are listed as corporate partners. Have done two this way and six under Living Trust without attorney help. No need to pay someone else 4-600.00 for what you can do yourself.That's money for other class 2 or 3 projects.

I've used the Trust method for years. It's a no brainer.

Had a estate planning attorney create it,using my input and wording I wanted placed into it. It owns all my guns,nfa or not nfa, scopes, anything gun related.

When I get the itch for a new NFA toy, I cut a check or CC.......then wait to recieve the Form 3s.........fill them out.....hit Print on my computer when I reach my trust document .........cut check for 200 to spare my dog's life..........stuff it all into an envelope.......wait 3-4 weeks.

Great information gents. I have two suppressors thus far and I am going to get more and also make some of my AR lowers NFA registered and I hate going to the Sheriff all the time to get things signed. He has thus far signed for the two but I hate going to see him as I am sure at one point he is going to start to wonder why I have all this stuff or at least that is my feeling on it. Or may be I am just paranoid

So quicken 2010 doesn't have the trust feature on there anymore?
I believe a trust will be the way I go being (correct me if I'm wrong) it would be much better for active duty military being that I move about every 2 years and trying to get the LEO sign off would become way to difficult?
My understanding is also that I do not need(am not required) to notify the ATF of moving the suppressor to another suppressor friendly state if you have a trust?

another +1 for SeanCody- He tailored my rather complicated trust to my needs. It's only 41 pages long! He charged me a bit over 10.00 a page. Not bad for legal work!
My other advise is to not buy one at all.....pretty soon you'll have a collection. It's addictive-

I just picked up my Element yesterday, 10 week processing time on a trust, and bought a new Serbu Super Shorty built on an 870.

This stamp's only $5 though.

Sean Cody contacted me here on the hide and called me the next day. He sounds like nice guy and is very knowledgeable on the laws. now i just have to sell my AR to fund the Trust and the SBR.
