    , VA — A 17-year-old boy is being persecuted because he and his 15-year-old girlfriend voluntarily shared naked pictures with one another. As if that were not enough injustice, the boy was forcibly photographed naked as evidence… and investigators want even more.

    Trey Simms, 17, is the teen at the center of this controversy. He has been charged with two felonies — manufacturing and distributing child pornography — because of the text messages shared between he and his girlfriend, who is two years younger than him.

    Police confiscated his cell phone and iPad as evidence. They also forced him to pose nude for photographs that would be used as further “evidence.” NBC Washington provided an interview with the boy’s aunt, in which she explained what has already been done to the boy:

    “He said they took him to a room and took pictures of his genitalia,” Stacy Bigley [Trey's aunt] said. “I asked if they’re allowed to do that, and [Trey] said, ‘I tried to refuse,’” which he did, he didn’t want to do it. They told him if he did not they would do it by force.”

    A local magistrate signed off on a new search warrant Thursday, asking for more nude pictures of Trey’s genitalia to compare with evidence. The teen said police wanted to force him to become aroused.

    According to the boy’s lawyer, Jessica Harbeson Foster, prosecutors want more nude photos of the boy — while he has a medically-induced erection. There is an actual signed search warrant to acquire “pictures of his erect penis.”

    When Foster asked how police were going to acquire the photos, she was told, according to the Washington Post: “we just take him down to the hospital, give him a shot and then take the pictures that we need.”

    “Taking him down to the hospital so he can get an erection in front of all those cops, that’s traumatizing.”
    Detective David E. Abbott of the Manassas City Police Department is the lead investigator of Trey Simms’ case. When the defense attorney spoke with the detective, he said that after obtaining photos of the teen’s erect penis he would “use special software to compare pictures of this penis to this penis.”

    “Who does this?” Ms. Foster asked. “It’s just crazy.”

    “This is a 17-year-old who goes to school every day, plays football, has never been in trouble with the law before,” said the boy’s lawyer to the Washington Post. “Now he’s saddled with two felonies and the implication that he’s a sexual predator. I don’t mind trying the case. My goal is to stop the search warrant. I don’t want him to go through that. Taking him down to the hospital so he can get an erection in front of all those cops, that’s traumatizing.”

    The irony of the situation is that in the process of “investigating” this so-called child pornography case, the government is itself creating more “child pornography” — by the state’s own definition. Whereas no victim existed when two teenagers were voluntarily showing pictures to each other, the government’s involvement has produced actual child abuse and humiliation.

    The government apparently will stop at nothing short of ruining this boy’s life. If Trey Simms is convicted of the felonies he has been charged with, he could face years in prison and spend the rest of his life as a registered sex-offender. All because of an activity that should not have been made into a criminal matter.

    I'm wondering if this whole thing is coming from the girls parents? I'm thinking they just couldn't understand how little Suzy could want to see his package (probably already been in her) and that some how she has been "raped". After reading about those kids that were labeled as terrorists because they wanted to dress against the school's dress code... All I can do is shake my head.
     
    Maybe there is more to this story than what is posted here. Yes, by law anyone posting naked pictures of underage girls/boys can be charged with distributing child porn. Law has been that way for some time. Maybe this kid is also sending pictures of himself to others so they are building a case against him. Just because people claim that he is "a good 17 year old kid, plays football and goes to school everyday" does not mean he may not have issues. What if you had a 16 year old daughter and some guy was sending her unsolicited dic pics. Going to hold off and see what the other side of the argument to this story is before making comment as the posted story only supports one perspective.
     
    This is so GD fucked up!!! What is wrong with people to allow law enforcement to stick it's cock in their brain washed asses??? Hell, law enforcement is abusing this boy sexually and they aren't getting in trouble!! What would happen if I forced a 17yr old to show me his cock for pictures??? Do these people not know how to call their senators and stuff??? It always works for me when you get the state capital involved...
     
    I wonder if this girls family is connected and this boy is not?? I've seen things like this in the south when the boy is black and the girl white... And the white parents don't want their daughter with anyone that isn't white.. If the law enforcement is making any type of excuses for the girl, and not seeming to be pushing the law at her, I bet, without looking at race, she's white and he's black, and the parents have local connections..

    At least admit that photographing a medically induced erection to gather "evidence" is over the top. Even if I were to take the strict view that it's what the law says and the law is the law, they already have a ton of evidence and I don't know how they go about forensically determining the identity of a penis.

I'm guilty of all types of sexual things with my girlfriends according to this town!! We all have had phone sex, this is just the modern day equivalent to that!!
     
    This is part of the statement released by LE:

    "On January 23, 2014 Manassas City Police was contacted by a parent of a 15 YOA female juvenile who was sent pornographic videos by a 17 YOA male suspect after repeatedly being told to stop. Upon further investigating the incident charges of manufacturing and distributing child pornography were brought against the 17 YOA male suspect on January 28, 2014 after consultation with the Commonwealth Attorney’s Office".

    After reading further, it sounds as though the teen will not admit to sending the videos so they are going to take these pics to further prove he is the one in the videos (he's a grower, not a show'r). If the teen admits to the crime, the photos will not be taken. Either way, kid has issues and I doubt this will be the last we hear about this one.

Teenagers sending each other naked pictures still falls under the child pornography statutes because they were written long before the technology boom. Some jurisdictions take a common sense approach, others don't.

    Virginia is notorious, (their State Police anyway) even amongst their fellow LE, for their complete lack of common sense in all matters. They take that "commonwealth" shit seriously. We had a whole separate briefing at Quantico about the dumb shit you could get in trouble for while there. Years later I was accepted to attend an ATF bomb course up there and the course overview prior to attending had a whole section on Virginia LE and the fact that they would happily arrest or issue citations to uniformed LE in marked patrol cars.

    I mean no personal affront to any Virginia LE guys here, I have buddies working up there, but even they shake their heads at the shit that the State Troopers do.

    Yep, absolutely agree about the professionalism, although most State Troopers are. The "difference" as it was explained to me is something to do with that Commonwealth status and how the law is applied.
