Why was the Presidents line item veto deemed unconstitutional by the courts years ago?

    Is it too much power by the stroke of a pen? How the hell else can you control/eliminate all the pork and bullshit hidden in a 1400 page :poop::poop::poop: economic stimulus bill, plus. numerous unrelated items. (ala party agenda)

    I am sure, without reading the document. that there are folks in DC that will profit from this , regardless. I am by no means a Constitutional Scholar, but it sure as hell seems that we need additional checks and balances .

    Term limits would help too in my humble opinion, although the corruption will probably always be there.
     
    I don't think it was... I thought that LIV was not tested (a President has never done it) because folks are afraid that it will not survive Court challenges

    Interesting historical fact... the Confederate States of America Constitution of 1860, included a Line Item Veto. They were thinking about it even back then. So there is historical precedent of sorts.

    In other words, even back then they knew that it might need Constitutional Change to enact.

    It blurrs the lines between the branches... as much as I am for it! It's an interesting legal argument.

    in 1998 the U.S. Supreme Court ruled the act to be unconstitutional in a 6–3 decision in Clinton v. City of New York. The court found that exercise of the line-item veto is tantamount to a unilateral amendment or repeal by the executive of only parts of statutes authorizing federal spending, and therefore violated the Presentment Clause of the United States Constitution. Thus a federal line-item veto, at least in this particular formulation, would only be possible through a constitutional amendment. Prior to that ruling, President Clinton applied the line-item veto to the federal budget 82 times.[13][14]

    while a line item veto seems like a good thing it could give a president broad powers and strike extreme partisan legislation.

    Uh-oh, am I at risk from being suicided by the Klinten Crime Foundation now? May have to go back and see what the composition of the court was at that time, not that it matters.

    he can still veto a bill that is sent before him if he don't like the direction it pushes . he still has veto power but one would hope the senate would do there job and remove the thinkgs that needed to be removed before voting to send a bill to the president . on a sad note wipes the tears from his eyes the dirty government closed down our local rifle ranges sorry had to point that out cause its just so sad why god why lol one state range down will have to try anthers yea the other states ranges are still open happiness still exists .
