how about attempted murder? never be more than 3 seconds from a gun. he is stupid as well,busting out a window with a knife and attacking. asking to be shot DRT. a member of the gov thinking he is immune from punishment like-now add 1000+ names.
bad thing is this will give the lib bed wetters a reason to bitch about stand your ground.

yup, because nothing shows care like walking up to a stranger's car with a knife in your hand, to see if they are all right.

I've never seen a person who is passed out who can still drive that's a new one.

I hope the victim sues the fuck out of him and leaves him having to need a loan to buy Ramen Noodles.
 
If the victim has no real criminal history patrick is screwed and will probably plea out before trial. On the other hand if the victim has a real big violent past /warrants etc and patrick still has friends in high places he will fight . What was the short version of the accident before patrick rolled up ?

Because nothing makes someone stop trying to drive away like stabbing them repeatedly through a car window.
I don't think the plot is thickening, I think the plot is being spun. Or at least they're trying to.

I’ve broken a ton of windows, and you aren’t using an open pocket knife to do it. I’m calling a BIG BULLSHIT on this guy standing his ground also. Zero excuses here for not knowing the law.

Fuck CNN, but this says the helpful bystander was slashed at by this twat too and he (bystander) thought it was a “medical episode” causing the driver to be unconscious. I’ve woken up quite a few passed out folks, some tense up when you do it, so plausible.

So who here would have shot the guy doing the stabbing assuming you witnessed the whole scenario?
I would have broke my rule #1 about no talking in a gunfight. Seeing as he had a knife it's only half broke. I would have drawn told him to stop. If he did, have him get on the ground and have someone call 9-11. If he came at me he would be explaining to St. Peter how he was completely right.

Of course Scruggs's attorneys are going to try to assassinate the character of the stabee. The stabber has no justification, so the, "hey, stabbee is a drugee with a criminal history" is their best shot.

They might argue that the first couple of stabs are due to the stabbee grabbing the stabber's arm, although stabbing him multiple times seems like a gross overreaction. Then, however, after pulling loose from him rather easily, what does stabber do? Commences to stabbing again, and again, and again . . .

Threatening to stab bystanders, etc. This former prosecutor is lucky he was not shot by somebody.

It is probably a good thing for him that stabbee was a guy with a significant criminal history, so it was unlikely he possessed a gun to shoot stabber right through the window of the car while still seated.

Anybody who shot stabber during one of his multiple stabbing episodes on video would have been hailed in the press as a "bystander with gun in Florida stops stabbing in public highway road rage incident." The police would have cut him loose with a high five.

Me. If I pointed when he appeared to be not actually in the act of stabbing, he would have receive a verbal warning first, if I thought I could safely deliver it without risking another stabbing to the stabbee, but if I pointed during one of the stab, stab, stab episodes, I would have pulled the trigger with no warning and no hesitation.

The biggest factor with respect to him having a gun and popping said stabber through the window is an Longitudinal thing.

The Howard Frankland bridge is in two counties, Hillsborough to the East, and Pinellas to the West.

If the Stabee was in Pinellas County, the DA would find several charges to throw at him.

If the Stabee was in Hillsborough County, it's more likely to be treated as if it were in Polk or Manatee County. Good shoot.

If the police had entered the scene while he was stabbing they would have shot him.
It was not his duty to stop whatever the man was doing. He inserted himself into the situation as though it was. He didn't know Jack shit about the man's background and is using that, later found, knowledge to justify his actions.
There is nothing wrong with stepping in to hold somebody for the police if you have probable cause to make an arrest (well, in every state except Georgia). And every arrest involves some level of force. The issue is that you have to use the minimum level of force to effect the detention. That is the law for the police as well as for you and me (and this former prosecutor Scruggs, although apparently he did not think so). Going through the window and stabbing the man half a dozen or more times with no provocation does not appear to be that minimum level of force.

Just think, though. This guy is going to prison, but he will do well there. He has already demonstrated his shanking skills. He will be high up in a gang as an enforcer in short order. Neck tattoos and the whole bit. The gang will distribute goodies to him from the commissary, maybe drugs, and young teenaged offenders for sex slaves.
