Suppressors Suppressor Application DENIED!!! Something to be aware of.

I'm honestly shocked that BATF caved and is going to address the denied applications. Hopefully it's not too much of a hassle for them to pull my re-submission for quick approval.

I am surprised as well. I haven’t heard any updates but I did email Mark when I got home this evening and ask if he had any updates for us. He hasn’t responded as of yet. I will try to keep everyone on here in the loop. I’m sure WJM308 will do the same.

Good news, just got a call from Mark and they have the full instructions from the BATF. Originally the BATF wanted all submissions to have new fingerprints, pictures, etc. but SS was able to negotiate to only new ink signatures to be required. So this is what is happening, the BATF has sent to SS the full instructions along with a "Blue Insert" that will contain all the new forms which must duplicate the original submission (this is very important). SS will be sending the new documents to be ink signed by your dealer to the dealer on record (more on this in a bit), the dealer should contact you to come in and physically sign the re-submittal forms, once you and the dealer have signed the forms the dealer will have instructions on where to ship the signed forms to be expedited. The BATF has told SS that once the checks clear for the re-submittal they will approve within 24 hours, they will then ship out the approved documentation to your dealer.

A few caveats to this process - the BATF is requiring that the re-submission be EXACTLY like the original submission, but what if you've moved during the time from original submission - BATF said they do not care, the submission must be exactly the same, and if you've moved, once you've been approved you will need to fill out form 5320.20 to submit a change of address to the BATF (you will do this after you receive your suppressor). Also, what if you do not live near your dealer or are not able to visit their shop to sign the documents, then you need to let SS know and they will ship the documents directly to you, you will then sign and ship the documents to your dealer.

Finally, what if you've asked SS to resubmit your documents already, that is okay, the expedited forms will be different from what you've submitted and those will be approved, your other submittal will stay in the system and when the examiner reviews it they will see the serial number has already been approved and they will discard the submittal.

In Summary
  • BATF has approved expedited re-submittals for those who were denied through the Docusign requirements confusion
  • Silencer Shop will be shipping to your dealer the new submission forms to be signed, these should start shipping next week
  • Hand drawn/ink signature is required for both submitter and dealer
  • BATF will approve re-submitted applications within 24 hours of check clearance
 
I got a call from Mark as well today and its EXACTLY like what wjm308 said. I guess this is the best we could hope for.

Just one question regarding "BATF has told SS that once the checks clear for the re-submittal they will approve within 24 hours, they will then ship out the approved documentation to your dealer." Not sure if Mark covered this but is SS still planning on covering the cost of our tax stamp up front or is that something we will need to pay and then get a reimbursement from BATF?

There is no additional cost on our part, I assume SS is covering that cost and will be reimbursed when the BATF issues the refund.

Was told I would have the cb7 before deer season....well season opens tomorrow. A little disappointed, but it was truthful. Lol

Spent some time putting the breaks in my rifles, and hoping to shoot some rounds tomorrow.
 
Talked to someone in Compliance at SS yesterday to get a feel for the timeline given that everything that @wjm308 shared and it appears everything is going to happen rather quickly.

From what I understood, SS/BATF will be sending out the new forms to the dealers for us to resign sometime this week/early next week. They are including full instructions and pre-paid/addressed postage to make everything as simple as possible on us and the dealers so that no further delays or confusion is likely to occur. They are sending out each of our applications individually as opposed to in batches by Dealer so that no one person is holding up anyone else from getting their paperwork signed and turned back in. I believe this applies to responsible parties on your trust if you have any. They will also be sent a form to ink sign and then mail back in.

Once we & our dealer sign the new form it get's mailed back where it will go to an examiner who will be handling these appeal based expedited applications on a high priority basis. Also, apparently our new check that they will cash for the new tax stamp will also be color coded with a high priority designation and will be expedited to clear ASAP at the BATF's Bank that all their checks clear from. So it doesn't look like anyone anywhere along the way will be dragging their feet to get these individual steps done. The way the girl in Compliance at SS put it, the BATF just wants this shit to be over with so they are trying to get it over and behind them as quickly as possible which is fine by me!

Hopefully we will all be getting calls from our dealers to come ink sign the new forms within the next few days!!!

Nope. My dealer is getting pissed as all his impacted apps keep calling him and SS isn’t responding to anyone

Spoke with my dealer today. They haven't received anything yet but said they expect it "soon".
 
SS has been good abt responding to me as well. I was referring to my dealer when i said he was bad abt responding. Mark at SS has been VERY GOOD abt keeping us updated.
 
id rather it take a couple extra days for ss to pump out the redo's, knowing that they used those days to manually go through and double check everything. would blow if they were hasty and then conflicts show and atf starts turning things back.

regardless of how you feel about how we got here to begin with, the guys have to be putting in a lot of extra hours to right this stuff.
 
Mine was a part of this whole debacle as well, got denied in the end of August, SilencerShop said they mailed the second new copy on 11/15/

He said the biggest hold up was getting their computer system to print the forms WITHOUT signatures. They worked thru it and had extra people working long hrs to ensure the packages were correct and in order.

Hopefully this has a good ending in sight now.

If the form packets were mailed out Monday then I would think they should be hitting here in Houston (Since SS is in Austin, TX) by today and therefore getting a call from my dealer to come in and ink sign. I'll report back if and when that happens. Fingers crossed!

My dealer is now on a first name basis with me. I call him every couple of days. No forms here in a zone USPS says should take two days. SS stated to me everything was shipped last week.

I hate to be the one to keep saying SS hasn’t been forthright with us, but what the heck? Even horse back pony express would have been here by now if everything was shipped when they said it was.
 
With the speed at which i'm seeing approvals, I feel like I could have just sent a completely new and separate form 4 and had it approved in the time it has taken SilencerShop to send out this "fixed" paperwork since my disapproval in august.
 
Just received a call from my dealer that they have received the new paperwork and to come in and sign...will be doing that tomorrow.

My dealer is in Gettysburg PA.
 
I just got a call from my dealer here in Alabama too for me to come in and sign mine.
 
Got the call 30 mins ago! New forms signed and sent!!!! Was given an estimate of end of next week or the following week.
 
Well I wish I could have been that lucky. I got to my dealer to resign my forms and Silencer Shop had sent 3 copies of paperwork for one can instead of paperwork for all 3 cans. Needless to say I was less than thrilled after driving and hour and half to sign these. I attempted to contact Mark and couldn’t but did talk with Matt in the compliance dept. I explained to him what had happened and apparently he could tell thats what they had done on his end. He told me he would personally fix it, get it sent out today and expedite the shipping to my dealer. Man what a let down.
 
My paperwork arrived today. Dealer says he’ll ship everything on Monday. Hopefully everything is home before Christmas

interested to see. my dealer was clueless last friday when i talked to them, but left a message with mark at SS and on wed this week the dealer called me in the know with my paperwork.

That was my understanding as well. It’s supposed to be turned around by the ATF in 24 hours from when they have it in their hands. Hopefully its by Christmas anyways! LOL
 
I'm going to have to call Mark to check on what is going on with mine I think. I never received a dealer call, and my orders page has updated twice with new mailing dates, the last being 2 weeks ago. Maybe my dealer doesn't have my contact info somehow, they don't exactly inspire much confidence.
 
Mark has been very hit or miss trying to get ahold of him through all this as I'm sure he's been pulled in a million different directions trying to sort all this out. So if you aren't able to get a hold of him right off the bat anyone in the compliance department should be able to help sort you out.

No calls to come pick up your long awaited can yet? Guy at my dealer was thinking as early as Saturday for me. Figured that was a bit optimistic but a guy can dream right!?

If you guys still haven’t received your paperwork, I’d light a fire under SS. It’s terrible it went this long, but I’d be really pissed if you get double screwed.

When I spoke to SS ages ago, when they’d still return calls, they said everything had to be sent to the ATF by Dec 15. We are less than two weeks away. Who knows if that is a SS deadline or an ATF.
 
Guys I work at silencer shop also. We are pushing to get this handled as fast as the ATF will allow.

The Oregon address is an ATF address, I believe this is where the expedited handling will occur.

SS was supposed to ship the paperwork to me directly because I live several hours from my dealer but even though I had them double check they still shipped out to my dealer first. Dealer mailed to me and I have signed the forms and have sent back. Paperwork is now on its way to ATF, I understand that the day the payment clears the ATF will approve the form, but even payment is supposed to be expedited. Hoping for the best here.

No I have not spoken to anyone that has their cans back approved yet. ATF is saying same day appovals... but in ATF speak that means a month or 2...

I am pulling for you! I hope you have your can this/next week. Please advise asap
