<span style="font-weight: bold">Phoenix Licensed Gun Dealer Sentenced for Trafficking Firearms to California</span>
July 16, 2010

Shawn Michael Nealon, 38, of Mesa, Ariz., a federal firearms licensee and owner of Cavalry Arms Corp., was sentenced earlier this month to three years probation, 300 hours of community service, and a $10,000 fine after pleading guilty on Feb. 18 to illegal firearms sales by a federally licensed firearms dealer to an out-of-state resident.

Imagine how bad this would be for gun dealers if the general public applied narrow stereotypical views to them in the same way that they are applied to.... oh.... let's say labor unions.

Yeah, that dude's going to regret that decision for a long time. Illegally selling weapons is bad juju, not to mention it feeds into the anti-gun crowd's perceptions about gun dealers anyway. Oh well.

What's wrong with selling to California? Assuming it goes through an FFL, and you follow the California DOJ rules, how is it any different than selling to someone in Texas?

The following quote from the press release is annoying. As if AR-15's = increase in crime and danger to society. The rest of the country doesn't seem to have a problem...

"This conviction was a good thing for all law abiding citizens of the United States, as was the sentencing. Nealon is now a felon who can no longer possess or own firearms. He cannot continue in the business of being a Federally Licensed Firearms Dealer nor can he sell firearms at gun shows. The system worked and I applaud the efforts of the ATF agents who investigated Shawn Nealon’s illegal activities and the prosecutors who perfected the court case. They all had a role in keeping the citizens safe!"

Yeah, that pisses me off.
I mean, he broke the law willingly (I assume) and plead it down to avoid jail time.

I'm more mad that he did this, just hurts our cause even more.

The BATFE doesn't help either, by making the laws so nebulous and open to interpretation; but it's pretty clear you don't sell assault rifles to Cali.

Shame on him.

Was this the guy that caught all that heat about some video clip advertisement? Some hoopla over his depiction of the terrorists in his advertisement? They tried to shut him down over it if it's the same outfit I'm thinking of. Looks like the attention may have been bad for business after all.

He sold rifles to someone who owned a home in CA and AZ but was a CA resident . He is really guilty of not doing his homework as to the legality of those sales . One of the owners of MGM targets sat down and spoke with him at length about the entire ordeal and thats what it really came down to .... Ignorance of the law . He has lost his FFL and a multi-million dollar business over this for simply not knowing . Its not like he was trafficking firearms to the Taliban and Mexican Mafia he simply thought that because this guy has a residence in AZ it wasn't a problem . You think he ought to do some federal time as well ?

Its not the first RKBA loving business in AZ that's going to be screwed for not dotting i's and crossing t's. We have extra ATF agents in state and they have their fine tooth combs out.......

While I thought the hadji video looked like a bad 'b' movie, I applauded their balls at the time, gun sales were up hugely after 9/11 but noone had the sac to be honest about motives.......

You mean you think they don't?

I think the generally public (excluding gun owners) see an expose on CBS about straw purchases or the number of "assault" weapons crossing into Mexico and believe all dealers operate the same.

Maybe I am missing something but wouldnt the buyer have to fill out a yellow or white or whatever the sheet color is now to purchased these firearms? Then the FFL would have to call it in and ATF approve it?

I'd go with "jackbooted thugs bend over another licensee". The last paragraph of the press release shows exactly what their motives were-appearances......

I had the same take, but my first response was "oh shit this guy is gonna get bent over by the ATF sooner or later"

i asked about this stinky deal earlier this year ...from those of us in the know,,,this was a set-up and some federal agent got a couple of gold stars for his career ......

a vet and a small businessman life is now fucked of one small consequence....

If it was a 'sting' and he broke the law purely unwittingly then I'm going to see if there's some kind of legal aid fund for his defense. I've never bought anything from him or even heard of him until now, but I don't think he deserves his life and livelihood trashed because of this.

I also don't consider this the best use of my tax dollars by the Feds...!!!
