The part we don't see is how the DA is pressing murder charges on the owner. It's clear that it's the owners fault, I mean if he didn't own the jewelry shop the three wouldn't have been tempted to rob him.

we had a pair here rob, er try to rob a liquor store. well EVERYBODY knows he carries. well not these two, lol. two men enter, one man left. well the other guy left too. this earth and that store when the coroner got there. i worked downtown and took the bus to work and even people on the bus laughed and said "everybody knows you dont rob Cormier". no chargesd filed. second guy was eventually caught with a few extra holes in him. both the old man and the wife carry. now its mostly a drive thru store too

In parts of Texas you could get away with it but if it were in Austin, I wonder. Same as in Virginia, there are parts of the state where it would be acceptable to kill a burglar/robber but other parts...it would be up to the Commonwealth Attorney if they will charge you and I can guarantee if it were in Charlottesville I know what would happen.

That is standard procedure in any 'homicide', imcluding completely righteous police shootings. The case is filed and sent to Grand Jury where it is 'No Billed', meaning no charges will be filed. Its just part of the system.

Now, things can certainly get sideways if the case is not presented ot Grand Jury properly. If you need an example, read Russ Claggett's book about his sniper shooting.

As you say, in Texas, all homicides by law must be presented to a grand jury. It's highly unlikely in a case like this that the grand jury will issue an indictment.
