Had to draw on someone today, police department held me at gunpoint

I want to make it a law that its illegal for LE to lie to you for any reason at any time.
Right. That way criminals can lie during investigations but cops have to be honest to a lying criminal to obtain information. That’s good thinking right there.

That's a good point unless you're the suspect and are REALLY innocent.
 
One of the best things I learned in my LTC class and with training vids from self defense insurance companies is that the first person who calls the police gets heard first. Ideally, brandishing a gun or not, I would call police when approached by the shirtless hooligan. And let them know ahead of time that I am armed.

If they ask ‘did you point your weapon at him’ or ‘did you brandish a weapon’ what is the best legal response? I don’t like talking to police (regarding an investigation), I don’t advise talking to police, and I advocate for always having a good lawyer friend on speed dial.

Good question. Anything you say will be used against you. Never mind the word "can." The words will be used against you. Ancient attorney advice: shut up. So, the first thing now is decide how much to show.

I wear my M&P 9 mm every day with an owb holster and a large fishing shirt over that. Texas is now constitutional carry. I would not admit to brandishing or pointing it. The less I say, the less an attorney has to backfill.

If the hooligan tells the police you were brandishing, say nothing. But call the police, first.

Situations like this have happened before. The bad guy called the cops first and claimed to be a victim of a guy waving a gun around threatening to shoot him.

With my state’s rapidly changing demographics, I am afraid that as a White man, other groups will be given preferential treatment over me, instead of equally. I experienced this firsthand with the Department of Justice in a clear-cut case of preferential treatment by other groups. It was only my own countrymen and countrywomen that assisted me in my time of need. The others were indifferent.

I was in a brutal self defense case many years ago, the gang was let out of prison early due to a jail overcrowding law, violated parole, and killed a few people down the street from where I live. I asked that my CCW be expedited because of this instead of having to wait a year for my appointment, and the minority groups could not have cared less about the imminent threats to my life, the felons that are actively looking for me.

It was my own countrymen and countrywomen that went above and beyond for me, made phone calls to the proper people, and took the time to listen to my story.

I had to observe a 3rd grade classroom for a college class a few years ago, the classroom where my mother and aunt went to school in the 60s, all with children of blond hair and blue eyes. Fast forward to the date of my observation, and 31 out of 32 children were children of first-generation mexican immigrants. One of the children was a White boy.

More than half of the latinx children had to take an hour out of each of their curriculum each day to participate in an ELD program - English Language Development.

The one White child was given free time to play and had his education paused while providing equity for the latinx children. With the amount of latinx flooding my state’s judicial and education system, it is clear that their own kin are being given preferential treatment while my countrymen are being passed over and not allowed to develop to their full potential.

I wrote a scathing report on my the American taxpayer should not subsidize English-Language-Development programs and got an standing ovation from my professor at the time.

Was coming home from the range and a shirtless hispanic male began tailgating me from the main road my range is off, at the top of a mountain a few miles before it becomes a steep downgrade. I slow to put my truck in 2nd gear so the brakes wouldn't heat up on the steep downgrade (one lane each way). Shirtless hispanic male (hereby referred to as SHM) continues to tailgate, honking horn. As we begin to go down the downgrade, SHM enters oncoming traffic to pass me, reenters right-of-way lane, and brake checks me to a stop. Gets out of his vehicle, visibly agitated. Begins punching my window and yelling at me. I reach to the passenger seat. SHM begins apologizing and says he is a mechanic that stopped to make sure my car was okay. I verbalize to deescalate and neutralize the impending threat with "get back" "go back to your car" etc. SHM returns to his car. By now cars have lined up behind us. SHM begins to drive forward then pulls aside into a turnout. SHM reenters traffic behind me. We get to the bottom of the mountain, SHM continues to follow me as I drive home. SHM ends up in front of me due to normal traffic.

About four miles later on the same road, I come upon an intersection, I have the green light. Police cruiser stopped to my left at a red. SHM, in front of me, begins waving his hand and pointing to my vehicle. Cruiser lights up and pulls in front of me. I bring my vehicle to a stop in the middle of the intersection, immediately roll down my window and put both hands out. In a matter of 1 minute, about 6 cruisers and a motor unit converge on the intersection surrounding my vehicle. SHM comes to a stop 100 yards ahead of me, out of the intersection, exits his vehicle, and begins video recording with his phone. K9 unit appears behind me. 4 officers with guns drawn begin instructing me on how to exit the vehicle and walk backwards. I follow instructions, they handcuff me and sit me down on a curb. As this happens, SHM gets back into his car and drives off. Officers pull him over a mile up the road.

I recite everything to the officers as I just stated, stayed calm and described to them the make, model, caliber, and locations of the firearms I had in the vehicle. They checked everything out. They noticed SHM was gone. After they got my story, and I assume whatever SHM had to say, I hear an officer speaking to SHM on the phone, stating he made a very bad decision approaching and attacking someone's vehicle. They informed him I was licensed and acted within the law, and that he was lucky he wasn't dead. The officer told him "If you approached my vehicle the way you did, and I had a gun, I would have killed you".

They uncuffed me, gave me a cold bottle of water, and apologized. I had a good conversation with them after, and joked with the officer that initially drew down on me. The range I was returning from is located in a terrible part of town, albeit secluded in the mountain from the urban area, and people like SHM are run of the mill there. It was clear the tattooed, shirtless hispanic male was a frequent meth user from his appearance.

I was just glad the officers gave my firearms back.

Say nothing. Call the number on that little key-chain tab Gun Shield (or whatever liability or legal coverage you have) gave you.
And Texas is NOT Constitutional Carry. If you live in Texas, and think that it is, you are in for a rude awakening.
Constitutional in a nut-shell, means no one can question your carry, if you are not actually committing a crime at the moment.
In Texas any LEO, who sees you open carrying, or even printing, can stop you, ask for ID, and run a background. And take your firearm from you while doing it ("just for my safety and yours, you know."). A lot of people THINK we got Constitutional Carry in Texas. We didn't.

So at what point did you draw your weapon again?? Because you titled the post "HAD TO DRAW ON SOMEONE..."

I guess missed the actual time you had your weapon in hand, and raised to the "suspect".

Whenever I drive I slap this bumper sticker magnet on the back of my vehicle, and it was there during the whole ordeal. I don’t know if it helped me or hurt me! 😂

I haven't read through the comments, so I may be just repeating someone else, and apologize for adding on to what's already here to read.

These days, if you draw your weapon on someone, you need to be the first to call police and report that you drew your weapon. Doesn't matter the situation. You call first, and you be the first to tell your side of the story.

I drew my revolver on a guy who had apparently approached my daughters (I didn't witness it) and they ran inside. I thought that maybe it was just a person that was walking up the road and perhaps they over reacted, so I went outside to see this person and the dude was laying on the ground right against my front door. No shirt, no shoes, and it was maybe 50 degrees outside, so not freezing, but definately not no shirt weather. He startled me and I instinctively drew my 38 (hammerless) from my pocket and stepped back and ordered him off my property. Once I saw he was leaving, I closed the door, got my phone and called police immediately to tell them my side, before he could claim he was just trying to put something in my mailbox and I pointed a gun at him for no reason. Police responded remarkably fast, and they were totally cool with me. They found the guy, he was apparently off his meds and having some sort of episode, and somehow ended up in our neighborhood. No charges filed.

So in the future, if you have some wild shit go down like that, get on the phone with the police asap, because if he calls before you, his lies are going to be what the police assume are the facts.

Glad you ended up alright, nobody got hurt, and you got an apology from the officers.

The statement was made that Texas does not have constitutional carry, i.e. permitless carry. So, Texas Tribune was one of many orgs that reported when Gov. Abbott signed into law the bill allowing carrying of a firearm without permit or state-approved training for non-felons and it went into effect June 1st of 2021.

So, I am confused about constitutional carry or permitless carry and is there a difference.

It’s a damn shame that a man has to invite statists with guns into his life, putting his wellbeing in danger, because he protected his own and is fearful from retribution of the state based off of false pretenses. Sad world we live.

This makes no sense. If you’re telling the truth and a cop says something that’s not accurate, then you’d know the cop is lying/bluffing. It works both ways. I swear innocent people give worse advice than criminals do. Criminals actually have real experience dealing with the law whereas john doe just draws all sorts of irrational and hypothetical what if scenarios.

A cop was asked about the armed antifa. H said it was their right. And he was right.

I shoot at a range at a base of the South Mountain hill in Phx and is surrounded with same such crazies. I was sure it was Phx Rod and Gun when I read the story. I didn't think you could have a gun and ammo in your car in CA?

Very happy to hear some very good cops in the streets, can't believe it worked out for you. Not sure if the junkie was smart or stupid for calling the cops. I think they were way too nice to him but who knows what they have to go through if they did charge him so no judgement.

Played connect the dots for a while then started finding star formations. I found the big dipper, Orion and a couple others.
