FBI: Mexican soldiers used rifles to chase off U.S. Border Patrol

CIUDAD JUAREZ, Mexico (AP) — Pointing their rifles, Mexican security forces chased away U.S. authorities investigating the shooting of a 15-year-old Mexican by a U.S. Border Patrol agent on the banks of the Rio Grande, the FBI and witnesses told The Associated Press on Wednesday.

The killing of the Mexican by U.S. authorities — the second in less than two weeks — has exposed the distrust between the two countries that lies just below the surface, and has enraged Mexicans who see the death of the boy on Mexican soil as an act of murder.

Shortly after the boy was shot, Mexican soldiers arrived at the scene and pointed their guns at the Border Patrol agents across the riverbank while bystanders screamed insults and hurled rocks and firecrackers, FBI spokeswoman Andrea Simmons said. She said the agents were forced to withdraw.

"It pretty quickly got very intense over on the Mexican side," she said, adding that FBI agents showed up later and resumed the investigation, even as Mexican authorities pointed guns at them from across the river.

A relative of the dead boy who had been playing with him told the AP that the Mexicans — who he described as federal police, not soldiers — pointed their guns only when the Americans waded into the mud in an apparent attempt to cross into Mexico.

The Mexican authorities accused the Americans of trying to recover evidence from Mexican soil and threatened to kill them if they crossed the border, prompting both sides to draw their guns, said the 16-year-old boy who asked not to be further identified for fear of reprisal.

The confrontation occurred Monday night over the body of Sergio Adrian Hernandez Huereka, who died of his wounds beside the column of a railroad bridge connecting Ciudad Juarez, Mexico, and El Paso, Texas.

Each government has made veiled accusations suggesting misconduct on the part of the other's law enforcement agents.

Hernandez was found 20 feet (six meters) into Mexico, and an autopsy revealed that the fatal shot was fired at a relatively close range, according to Arturo Sandoval, a spokesman for the Chihuahua state attorney general's office. Mexican authorities said a .40 caliber shell casing was found near the body, suggesting that the Border Patrol agent might have crossed into Mexico to shoot the boy.

That would violate the rules for Border Patrol agents, who are supposed to stay on the U.S. side — and could open the agent to a Mexican homicide prosecution.

<span style="font-weight: bold">A U.S. official close to the investigation told the AP that authorities have a video showing that the Border Patrol agent did not cross into Mexico. In fact, the official said, the video shows what appear to be members of Mexican law enforcement crossing onto the U.S. side, picking something up and returning to Mexico. </span>The official was not cleared to speak about the video and spoke only on condition of anonymity.

Alejandro Pariente, Chihuahua state's regional deputy attorney general, said the U.S. Border Patrol has given him video which he is reviewing. He declined to describe it except to say that it has sped up the investigation.

The two killings have provoked anger in Mexico like no other recent controversy surrounding immigration, including Arizona's new law making it a state crime to be an illegal immigrant and President Obama's decision to send the National Guard to the border.

Although many Mexicans were unhappy with both initiatives, popular and official reaction had been subdued, in contrast to street protests seen in previous years when the U.S. has cracked down on the border. Many Mexicans have since given up hope for a quick solution to the immigration problem, while other issues including growing drug violence have taken center stage in relations between the two countries.

That has started to change with the back-to-back deaths of two Mexicans at the border: the teenager killed Monday, and migrant Anastasio Hernandez, 42, who died after a Customs and Border Protection officer shocked him with a stun gun at the San Ysidro border crossing that separates San Diego and Tijuana, Mexico. Anastasio Hernandez, who had lived in the U.S. since he was 14, was buried in San Diego on Wednesday.

Mexican news media were filled with images of the 15-year-old's bloody body and his grieving relatives. One tabloid ran a large photograph on its cover, with the banner headline "Grindaderas," salty slang that roughly translates as "things Americans do."

Mexican President Felipe Calderon pledged to "use all resources available to protect the rights of Mexican migrants," and his foreign secretary, Patricia Espinosa, said Mexico wasn't taking the Americans' word that the Border Patrol agent had been defending himself from rock-throwers when he opened fire.

Chihuahua state Gov. Jose Reyes Baeza blamed the two killings on racism fueled by Arizona's law.

"We believe that this killing, the second in recent days in the border between the two countries, is due to xenophobia and racism, derived from the approval of Arizona's anti-immigration law," Reyes said.

Meanwhile, the Border Patrol released statistics showing that assaults on agents along the border between El Paso, Texas, and Ciudad Juarez, Mexico, were on pace to far exceed totals in the previous four years.

In the past seven months, Border Patrol agents in the El Paso sector have been assaulted 33 times, compared with 39 times in the entire previous year. Twenty-nine of those incidents were rock-throwing, compared to 31 such incidents in all of fiscal 2009.

That's what happened Monday night, when suspected illegal immigrants who ran back to Mexico began throwing rocks at Border Patrol agents detaining other immigrants, Simmons said.

At least one rock came from behind the agent, who was kneeling beside a suspected illegal immigrant whom he was holding prone on the ground, Simmons said. The agent told the rock throwers to stop, then fired his weapon several times, hitting the boy, she said. The FBI is leading the investigation because it involves an assault on a federal officer.

The agent was not injured, Simmons said.

T.J. Bonner, president of the union representing Border Patrol agents, said rock throwing aimed at Border Patrol agents is common and capable of causing serious injury.

"It is a deadly force encounter, one that justifies the use of deadly force," Bonner said.

Mexicans ridiculed that stance.

"Let's say that Anastasio and Sergio Adrian attacked the border agents, one with his fists and the other with rocks," columnist Manuel Jauregui wrote in the newspaper Reforma. "Does that mean that killing them was the only valid option?"

OK. There you have it. The Mexican Federal Police (kind of like our Border Patrol) was going to shoot the Americans if they crossed the border.
I believe a precedent has been set. And I believe we should, in turn, shoot anyone who tries to cross the border into the US.

I remember reading of an incident about a century ago, we sent military into Mexico and they rode/marched all the way to mex city. Maybe time for a 100 yr celebration of that.

i wonder how many of the big talkers in here could really put lead in an unarmed kid just because he is mexican.. hmn.. i also wonder if that'd make you more of a man than me, or less of a man. funny how nobody wants to put lead in any of the BP officials, the oil leak is gonna cause a hell of a lot more problems for your country than a few mexicans throwing rocks.

anyways, cell phone footage of the incident seems to show that the kid was shot on the mexican side of the border.. this case is gonna get interesting real quick.

I see no one in this thread advocating putting lead into unarmed kids. The provocation by the Mexican government, the obvious flaunting of our immigration laws by all parties involved, and the cynical and hyperbolic whining about Arizona's law (just the federal law, only actually enforced...) are a ploy. One only dumbasses and exploiters of the situation fall for or employ.

Parties that could not care one "shittle" bit about the welfare of Mexican immigrants but do want them to come and become permanent democrat illiterates, wage depressing labor providors, endlss shit bag lawsuit litigants, and provide the next crop of race hustlers, with no productive work to do, mobs for their personal enrichment.

The distraction or deception of morons who continue to ignore the easily grasped reasons why immigration laws are important, due largely to the fact they involve the ability to understand sentences longer than three words, is what drives this supposed controversy.

In fact, there is no ambiguity. Illegal immigrants from Mexico are here because the lazy socialist theives that run their country welcome them to leave. This makes it easier for their typically zero sum view of economics to proceed: A system where lazy, indifferent nepotists, continue to indulge in 8 week vacations, 6 hour work days, lavish retirements, protected/inside career tracks for relatives and cronies, and a declining pool of actual goods and services produced. Kind of like Europe without the declining birthrate!

As no parasite likes to be told he is a parasite, he typically ignores the damage he causes, even to the point that a nation like Mexico, flush with the equivalent of natural resources, and hardworking people, as our own nation, can only imagine their own standard of living holding or increasing, if they steal from or exploit the wretchedness of others.

Thus the poor and desperate people of Mexico, forcibly disarmed so as to prevent their justified revolt against so horribly mismangaed a nation, are driven to break our laws by the parasites of their own ruling class, who feign sympathy for them but in reality only wish to loaf about on the tax revenue generated by a diminishing pool of productive earners, the remittances sent home by expats and the illicit money of the drug trade.

It is not coincidental to have you, SickBugs, make such a comment coming as it does from a resident of yet another nation whose chief export seems to be little more than scolding and arrogance.

And remember, it is similar leftwing assholes who don't want unsightly drilling rigs "in their backyard" that forced this one out into 5000 feet of water.

Nobody here wants to put lead in an unarmed kid because he is Mexican.These Scumbags Were Armed with rocks that they were throwing at our Border Patrol while he was apprehending a guy who Illegaly crossed the border.Be willing to bet that he was also greatly outnumbered.

theres definately no doubt that the border issues need to be fixed, we are in a very similar situation here in barbados, with a population of 300,000, yet we have anywhere up to 50,000 illegal guyanese immigrants. its a massive burden on a country, jobs taken from those who deserve first choice of them, rise in crime, etc. its even worse that they will not, when in rome, do as the romans so to speak, they expect to come to your country, not even show the common decency of learning to speak english.

however the underlying tone in some replies in this thread suggest heading down to the border, civillian snipers, testing out new toys etc etc. but what will this solve then? when the family members who are already in the states decide to take revenge? its a messed up situation for sure, one that has no easy soloution, or, in all actuality, no soloution at all.

we are a 3rd world country with a division of the police who mirror your swat guys called the task force, nobody down here wants to f*ck with the task force

We have had peace officers shoot U.S. Citizens for the same thing.

Something serious has to be done about illegal immigration soon and maybe things like this will push it to happening.

They just busted a Mexican gang here in WA 2 days ago. most of them illegal.

We need to take our country back.

But wait, we're afraid of other criminals here showing their face by committing crimes of retaliation (against capital law enforcement, a mexican tradition of all things)? Bring it! I don't doubt our LE's ability to catch people given the public pressure authorizing them to do so. In a matter of escalation, there's only one outcome, and it's not us moving to Canada. We only lose so long as we sit here, literally getting walked over. We need LE, local and federal, to be allowed to defend the citizenry.

When Mexico is drawing guns on the FBI, it's like Iran doing nuke testing or NK chucking rockets over Japan as a test. The only real test is the resolve of the greater power and whether they have given you complete control. If there's a miscommunication somewhere, it should only take a second to find out why the FBI is where they is to ensure guns stay holstered. There's no miscommunication when they come out when it's the chihuahua and the big dog. Those are ass-cheeks in your face.

Now, about the vigilante tone you mentioned... I am not seeing it in this thread (I have on other sites, but it's more hyperbole and bravado than attempt @ action). A troop of vigilante snipers would be probably, no, certainly, be ordered apprehended at all costs be brought up as reason #1 why we need more enforcement, no no, why we need new gun laws domestically, and how group X, within the US is actually our greatest concern, not external group Y or man made disaster causing peace loving folks on TV of yesterday.

I was not present at the "incident" that took place but I have a feeling that the agent who shot the boy didn't say, "Hey look! There's an unarmed Mexican kid. He looks to be about 15 or so. Watch me shoot this fu**er!"
Most likely, when they found themselves under attack by a rock-throwing mob, the agent looked around,saw someone getting ready to throw a rock, and shot. Much like a police officer who shoots a teenager brandishing a toy gun. It is unfortunate, but the officer/agent made a decision to defend himself based on what he knew at that moment.
Lets not forget that a group of people throwing rocks was, for many years, a preferred and effective form of execution.

I have to agree with qq's overall synopsis of the situation. Parasite's at both ends of their system, and they become parasitic upon ours upon arrival. She does not want to pay for a superb individual who is highly trained when she can go on the cheap and get mamasita to do the work under the table. It is her husband who sees all that big yard and his hammock and hires them to cut his lawn and landscape instead of using the local guys who do the work for a livable wage. It is the unscrupulous dirtbag restaurant owner who hires these fucks to cook everything and drives down what was a livable wage to a minimum wage job(I hate these most vigorously).
I would one day celebrate most vigorously and 'have a coke' when these issues are gone

Nothing will change. The current status quo is a very powerwful and unholy alliance of business interests, latino activitis, progressive democrats, mexican elites, and short-sighted consumers.

Gee wonder who was the POTUS at the time who signed onto SPP?
