SEAL Gallagher’s trial delayed after Navy judge calls for probe into email spying

Someone needs to have his career and reputation restored. Someone needs to go to Portsmouth Naval Prison (I know they closed it... doesn't mean he should not go there.) Spying on defense attorneys? Instant captains mast! Out on the street, demoted to seaman first.

Wonder which Obama litmus test this 'prosecuting' officer passed? The one that says 'warriors are to be emasculated, oaths are not to be kept and if you kill a Muzzie, you get prosecuted?' That litmus test?

I think aot of brass should be hitting desks or worse over this mess. And now it will only lengthen the time till a trial for the SEAL and his family. More uncertainty and unknows with no end in sight.

Previous administration ensured the Officer ranks were in line with their plans rather than adhere to core values and the constitution. That's at least partly how.

There should be captains's masts all the way up to some admirals over this. The Proscutor's entire chain of command needs to be expunged... pour encourager les autres... to quote Napoleon.

Because the fish has rotten from the head down since 2008.

When the DOJ gets away with selling guns to Cartels, the IRS can target opponents politically opposed to the admin in power, when Journalists working to expose the malfeasance of the admin in power are targeted, when the admin in power will let Americans die for political expedience than lie about it, when the admin in power will spy on a political candidate, when the admin in power will skirt FOIA rules by running off line communications systems, when the admin in power will than change rules on "unmasking" to try and muddy their footprints on the spying, when the admin in power will than conduct a coup to try and overthrow the duly elected President, when the admin that was in power will refuse to enforce laws against its own while zealously enforcing those same laws on political opponents than we end up with a piker small fry petty ass Captain or Major that thinks he can break all the rules of the criminal justice system even the UCMJ system.

maybe the prosecutor could just shrug his shoulders and say I don't know or did I do that..... it worked for Hillary . I'll still send prayers for the seal release and his family .

Holy smoke... did you see today’s twist? The team medic said that Gallagher did not kill the terrorist Taliban... that he put his thumb over the guys breathing tube. He simultaneously, under oath, admitted to causing the death and may have exonerated Gallagher.

This guy was also a prosecution witness!!!!!

The prosecutor in this case has fubard at a level that should land him in the brig... Not Gallagher.

The prosecutor, Lt. Brian John, accused Scott of lying, saying he had changed his story only after being granted immunity that prevents him from being charged in the killing.

"So you can stand up there and you can lie about how you killed the ISIS prisoner so Chief Gallagher does not have to go to jail," John said. "You don't want Chief Gallagher to go to jail, do you?"

"He's got a wife and family," Scott said. "I don't think he should be spending his life in prison."

Scott met repeatedly with investigators and never revealed he had anything to do with the death, John said. He had always asserted that there was no way to save the prisoner's life.

Scott said no one asked him how the patient died and acknowledged the immunity deal allowed him to finally fess up.

He wanted to invoke his Fifth Amendment right against self-incrimination when called by the prosecution, but the judge rejected that. Capt. Aaron Rugh granted him immunity and ordered him to take the stand.
 
His immunity agreement may have been conditional. In any case with his testimony Gallagher will likely be found guilty anyway.

Maybe if something like conduct unbecoming... but if the team medic said that the wound inflicted did not kill the Tali... and that he blocked the air tube because the case was hopeless and he didn’t want the guy to suffer or somesuch... then it may be hard to make a murder charge stick.

Nah, reasonable doubt is completely gone now. A witness testified that he saw the defendant stab the decedent. Due to the inability to establish cause of death or intent it’s just whatever the equivalent is of assault with a deadly weapon. Not sure if lesser included offenses are a thing in the military but I’m guessing Gallagher will be old when he leaves Kansas.

I have first-hand knowledge of two GIs acquitted due to reasonable doubt.
 
What reason do you have to doubt that he stabbed the decedent?
None, but if the wound was not fatal, they charge should have been attempted
Murder or assault. And if the team
Medic is willing to say the case was hopeless and we did him a favor by administering a coup de grace... well, there is a long tradition of that on battlefields. And is a lot different from murdering a healthy prisoner.

I didn’t say they acted in the best marquise de Queensbury rules... then again, a guy in civilian clothes on a battlefield shooting at you as an irregular can be summarily executed as a Spy anyway, can’t they?

Lots of fog of war when you want to play guerilla fighter against the varsity.

If it was a Enemy Combatant then give the Seal a metal . Government trained and programed you to kill during military engagements, no one should question how you complete the task. Killing and raping innocent people during military action, then yes hang the bastard.
 
Right, which is why I said he’s now dead to rights on assault. If they can breach the other guys immunity they will have him on murder. What a shit show. NSW needs to unfuck themselves.

It’s legal under the GC and HC to execute unlawful combatants with essentially no protections and I have no moral objection but until it’s allowable under US law that is a moot point.

"Standards" Would you say killing the enemy with a 22LR with one shot to the head be morally appropriate as a Standard. If so if you use a 50 cal. and completely remove the enemies head , would that be in moral and against all Standards ?

A point that hasn't been mentioned in the stabbing, latter posts is that it can depend on the circumstances at the time of the stabbing. If it was still battlefield conditions and active fighting, the the stabbing could be deemed reasonable. If conditions had calmed and no more heat of battle when the stabbing occurred, then maybe not. It xsn depend on the monent the stabbing happened. Thats why its the totality of the circumstances and reasonable doubt.

There are also a lot of charges stacked in him so maybe guilty on some, not on others. It will be in the hands of his peers.
