Suppressors Suppressor Application DENIED!!! Something to be aware of.

Hey Mike, are you aware or heard for that matter of any folks who were a part of this appeal that have already gotten their cans?

I signed my corrected Form 4 on Friday 11/20 and it was mailed back to ATF same day. Got an email notification from you guys saying my check was cashed on 11/28. My thought process, based on assumptions from the conversations I've had with Silencer Shop Compliance folks, was that I'd likely have my can back sometime this week if not already. Could be a bit optimistic but was curious if you had any similar cases that I could reference to understand a time frame.

Have you called to see if the ATF has your application in their system? They only show my denial in the system even tho the new check has been cashed.

So it's possible that it might not be going through their normal system. When you called did they say that it would show up in their system once it was received or did you get the typical bare minimum response? I swear it's like pulling teeth to get any information out of them.

Those answering the phones didn’t seem to know anything about the process. They were extremely nice. Searched their records validated the serial number and confirmed it was in my dealers inventory, but really she was just trying to search something to provide any type of answer to a question not asked.

It is odd as last time my check was cashed and the application showed pending within a day.

I called again today to see if my new application was received yet. Check was cashed last week, but they still don’t show the app yet.

I spoke to the gentlemen on the phone regarding these rejected apps. He seemed to be knowledgeable about the process. According to him, the applications went to Oregon first for the checks to be cashed before being sent to West Virginia. When I asked how long it took the applications to show to West Virginia, he stated it would likely be 6-8 weeks before they arrive in WV. Not quite the one day turn that we have been sold.

This makes me think it might be a one day turn as soon as the applications arrive at the correct location, but it might take two months before they are there.

I’d sure like Silencer Shop to comment on this. I was told by them not to a cancel my order in early November because this was resolved and would result in one day turns. The only disclaimer they stated was the turn could take a few extra days due to an influx of resubmissions at the beginning of this process. Two additional months was never discussed.
 
I'm out of the suppressor shakedown after this. I have to get trustees to sign more forms and hope for the best from the AFT this time around. Yea, sure "One day turn around". And you believe it?

Nope. Not doing it. I'm not a trained, clapping seal for the ATF.

So, the ATF will reject the one they kicked back, along with two other form 4s caught up in this same BS somewhere lost in ATF land. I'll use what I have and write off these. Probably eat the fees and what I paid for the suppressors too since it is all my fault you know.

We'll see.
 
I never expected the “one day turn” to really come true, but I did expect a clearance in a week or two or I would have cancelled. This stuff has gone on long enough and no one, not a single party, has taken responsibility for this failure.

Yes, the ATF pulled and absolute big D move, but honestly if you read Silencer Shops appeal they reference a variance letter which stated the signatures had to be in appearance to the individual’s true signature. Silencer Shop should have had this on their audit before applications went out the door. Dealers should have know not to sign this way.

Has my dealer taken responsibility? No

Has Silencer Shop taken responsibility? No. I’ll give them some credit for not telling us to shove it, but it likely had to do with economics.

Do I expect to ATF to give a damn? Nope.

So here we are. Waiting for what was only supposed to take “two weeks” to resolve and “one day” to turn.

Silencer Shop, if you are listening, for those of us impacted, you likely lost us has customers. You at least attempted to make the eForm1 failed customers whole. I feel like you’ve told us to pound sand with your words and actions.
 
Talked to me dealer on Thursday and as I expected he hadn't seen any of the stamps from the appeal come in yet and was as much in the dark as we are.

On the way home I though "what the hell" and called SS to see if I could get someone in compliance to chat with on the drive home. Maybe they had some insight. All compliance officers were busy so I left my info with the gentleman I was speaking to and he sent an email to the compliance team to return my call. Still waiting on that call back...

I'll let y'all know if they do and have any additional info on the matter.

Well, signed the paperwork on 11/22 and it was mailed immediately afterwards. No check cashed email, no check cashed note on my SS My Orders page, and received my second Immediate Action Required: Signature Variance Update from Appeals@Silencershop at 1:07pm today...WTF. This whole process has been a shitshow.

All i want is to be done with this nonsense. Comms from SS during this process has been poor at best.

I finally got my callback from SS today (originally called and left VM on Thursday midday. Spoke with Kate (ext. 106) who was cool and has helped me with information before. Wasn't helpful for what I called for as she didn't have any visibility on if any of the individuals with appealed forms had been approved and or recieved their stamp for that matter. However, I mentioned your situation about BATF not even showing your application in the system when you re-signed and submitted about the same time as me if not earlier. She said that if they still weren't showing it to definitely give SS a call and they'll see if they can sort it out with some of their contacts at BATF. With you in mind I started to worry myself so called today to check my form 4 status and low and behold it was APPROVED today!!! So now we'll see how long it takes for the stamp to arrive at my dealer.

@Dan M - I wouldn't read too much into the SS email about the appeal as I received the 2nd one today as well and my check was cleared with BATF right before thanksgiving. Looks like they are just sending it out to everyone that was part of the appeal as a reminder in case you haven't gotten your forms resigned. I'd keep blowing up SS until you can get someone on the phone and get it sorted out.

I called and checked. It was in their system 12/2 and I was approved today.

Glad to finally have this over. Never thought 420+ days would go so quick.

I got an email on 12/5 that all 3 of my tax stamps checks were cashed on 12/4. So hopefully I will be approved in the next few days as well.

Anyone else heard that they were approved like throwaway118? Thats awesome for you btw!

At this point, you should have heard from us by email and your dealer regarding paperwork you (and your responsible parties, if applicable) manually have to sign at your dealer’s store. This paperwork must be signed in-person to qualify for expedited approval. Your responsible parties are required to sign in-person as well.

So I called the ATF today and they say I am not even in the system again, all they show is the prior disapprovals. Although I got an email from Silencer Shop on 12/5 saying my heck were cashed on 12/4. The guys who have been approved, did y'all call the regular ATF number or the NFA Variances number?

I called the standard number. They didn’t show the application until yesterday after it was approved. I don’t have any contact information other than the main number.

Not sure why there was such a delay in showing the new application in the system. I’d just assume they have your application since the check is cashed, but clearly they are not sticking with the 1 day turn, but the approvals are starting to come.

That makes me feel a little better that yours wasn't in the system either until the day it was approved. What day did they cash your check?
 
My check was cashed on 11/29. Pending 12/2. Approved 12/9.

I suspect that they are not following the normal process for entering information, which is why you are not calling and finding it pending a day after the check was cashed. It sounds like very few have been approved looking on Reddit. I can only find mine and @Dutch260's application has been approved. Seems like a very slow process or others impacted are slow go in and sign their applications. This might explain why SS sent out two emails to go to your dealer and sign.

Either way, the end is near (finally). I really hope that SS learns from this. Communication has been terrible on a mass scale, I think everyone can agree on that. Others have pointed out discrepancies in SS's story, even what we were told when we called. Timelines don't add up, dealers have been stating this was a known issue since before our applications were submitted, etc. But anytime we spoke to SS, the story was they were caught off guard that these were issues.

I really hope that SS is planning some type of gesture of goodwill. Clearly, in my previous posts, you can see I was not (and still not) happy with SS. Stuff really does not add up. Communication of the process by the ATF and SS has been lacking. Conflicting information (re SS 1 day turn vs ATF 6-8 week turn) was everywhere. This only increased anxiety (again). SS can't be held on the hook for the ATF's system not showing in their system, but they can be held on the hook for their communication (one day turn). Since I have only heard of two applications being approved, it is hard to see if the one day turn will happen with any application. They should have messaged "quick turns" or "somewhere around a week or two".
 
I received notice from Silencer Shop my check was cashed on 12/7, based on Throwaway's timeframe, hopefully it'll be approved around 12/17... once the suppressor is in my hands it will have all been worth it, but waiting almost a year and then having it denied was the absolute worst!

I talked to the ATF again today and mine have went to pending now, my checks were cashed on 12/4. Maybe not much longer for all of us.

When Silencer Shop sent our forms my dealer was missing the responsible person section for our trust. Finally called yesterday and said they got it all squared away. Wife and I went down that afternoon and signed it. Dealer said it would go out in the mail today.
And the waiting begins........again
 
I spoke with Mike last week, he was very helpful about my situation which is a bit unique. My SOT went bankrupt due to incompetence and all their pending cans were taken over by another shop, The Armory. Unfortunately due to what I suspect is also incompetence and not really caring, my FFL said he never recieved any of the paperwork from SilencerShop even after it was re-sent, or a control letter from the ATF which I need to get my forms expedited. All the FFL says when I call is "we havent got any letter". So it is doubtful I will get my can approved in time.

But like I said, Mike and everyone at SS was very helpful, we both kind of realized my SOT was being a dick and screwing me, so he said SS could cancel my tax stamp so I can resubmit at another dealer, so I at least am not out the $200. But still looking like probably 4 years since purchase before I get this thing.

And the kicker is this dude at the SOT won't even answer the phone when i've called to get the form 3 started.

To be fair, this is the BATF, I think we all knew it wouldn't be 24 hours, but 2 weeks is still pretty impressive, especially in view of thinking I'd have to wait another year.
 
I wish I could have been one of the fast tracked ones. I just waited 12 months for a Nomad. Had some friends get the back in 3.
 
I just heard that the stamp for a suppressor I ordered using my trust last January is in. I used the same Docusign process through SS in January 2019 as used for the screwed up October 2018 suppressor. No hassles with the January submission, just a ridiculous wait.
I was ordering one every three or four months just so I'd be getting one in regularly. The Oct 2018 snafu put a wrench in that program.
 
Called to check on my suppressors this morning and all 3 were approved yesterday so they must be working on Sundays too. Shortly after that, Matt from Silencer Shop called to tell me that my suppressors had been approved. Maybe I will have them in hand before Christmas.
 
The suppressor Gods finally deemed me worthy!!!! Got the call this evening to come pick up my can!

I didn’t get the call today, but hopefully this week. It stinks since I’m on the road until Thursday, but hopefully it’ll be home by this weekend.
 
Pretty sure my dad didn't send a new check with the updated paperwork for the trust so that will be another setback.

Check was cashed on 12/07, called BATF this morning and application was APPROVED on 12/17. Based on comments above, looks like it is taking BATF 10 days from time check is cashed to approve. BATF said paperwork is already on its way to my dealer. Merry Christmas to me. What a frustrating road, but to be honest, Silencer Shop was able to get this resolved quicker than I thought they would, we're dealing with a government agency here and I'm shocked they made any concessions to SS!
 
Got a call from dealer today, my tax stamps are in. Guess I also get my suppressors for Christmas. It’s been quite a wait at 16 months.

I should have updated mine as well. My stamp and suppressor is home. I learned a lot with my first go around. I’m still plenty pissed at SS. I can’t decide if I’ll be using them again or not.

My main bone to pick really is what caused this whole mess. I never heard from a SS employee that they were not following their variance letter as has been discussed in other forums. Rather the story line was always these were rogue ATF agents. While both might be true, I never expect to get straight forward answers customer service from a government agency. For a business a dropped $1k with, the least I expect is honesty. If you screwed up, you screwed up. But be honest about it.

Anyway, I’m checking off this forum. Thank you all for sharing information as we pieced this entire mess together.
 
After 15 grueling months, I finally was able to pick up the beautiful TBAC Ultra 5 suppressor yesterday! Thank you Silencer Shop for helping to push this through and get quick approvals for those of us who were denied due to a signature without any request to provide a correction.
 
I just found this thread and it sucks because today I docu-signed electronically for my first suppressor purchase. Why did SS nor mg dealer tell me anything about ink signing? Is this something of the past perhaps?

I will make a call to SS tomorrow morning and try to see if we can still fix it to where I sign with ink. My dealer was out busy today and did not send the documents out yet.

This is old news, and is no longer an issue. It was something about an auto generated looking signature or something. Forget you read this thread.
I'm glad I read further into this thread... I saw the title, and was like WTF??? Cause I've got 3 cans in jail right now, all were done with SS and the kiosk, and with DocuSign. But I physically signed all my DocuSigns, so I guess we're good to go. 👍🏼
 
Its why i dont deal with SS - half their employees are complete morons, their comms suck ... did 2 transfers with them, never again - and never had an issue when i dont use them.
