About 18years ago, I sat on a Grand Jury listening to case about a local Police officer who was shot and killed chasing a armed robbery suspect. The suspect shot at the officer, hitting him on the top of his protective vest. The bullet deflected up, entering the neck.
Those were some disturbing pictures.

Seriously, though, I read the charges are aggravated murder, rather than capital murder. So, I don't know if Utah allows the death penalty in aggravated murder charges. And I get it, agg murder is more likely to stick with even a grand jury than capital murder because it could be argued that the suspect is unhinged. And Kirk was not a member of a government entity.
