The Next Trayvon Martin Case?

This is second degree murder. Brandishing firearms, letting off a round, hell kidnapping even etc, all can be easily shown to be indicative of intent. The jogger was in a white t shirt, shorts, no swag bag or apparatus of the common and proficient burglar. Furthermore, if as suspected, he was the repeat and hitherto successful burglar, why then would his otherwise wise judgement suddenly fail him and cause him to jog, in daylight...

This victim made the mistake of forgetting where he was and where people around him think his place ought to be.

No doubt somebody was. Likely the 4; but for me at least, I'd save that for the authorities. I was just amazed that somebody would think they should risk an armed confrontation in a situation like that - one where most certainly he had the short straw.

That's the relevant statute the DA cited. I guess he felt they acted within it.

You can't point a shotgun at someone without cause; no, being on the streets and black is not a cause, and have legal or moral justification to shoot them when they go to defend themselves by trying to remove the shotgun. If Ahmaud had been ccw'ing, he would have had grounds for shooting first.
 
Maybe I missed it. WP is reporting the shooter was a former DA investigator. Could this be a factor? After several over-reaches an under-reach seems likely by justice depts. to me.

The fact of the matter is there’s a video showing these guys aren’t 100% in the wrong. There’s nothing wrong with asking someone to stop and talk to them, there’s nothing illegal about doing it while armed. The dude never point the gun at him and it’s quite clear in the video. HE ATTACKED THEM. Fucking period. You can not argue with that, it’s literally on fucking video.

Now whether they should have really been there in the first place seems very debatable, but regardless of how stupid it was, I fail to see how it was illegal and I don’t think anyone on a jury would see it any differently.

When he decided to attack them and fight over the gun, the game changed. He decided to do that instead of going the other way. Why the fuck would he continue running towards them and attack them when he was clearly outmatched? I don’t believe this guy was innocent, regardless he should have gone the other way, that’s what a reasonable person would have done, he clearly wasn’t reasonable which should tell you he had a different motive.

I see them being found not guilty and a shit storm to follow. I don’t believe they’re guilty of murder based on the fact that the dead guy started the fight, but they’re definitely guilty of picking a really stupid battle. One they should have handled much differently. They should have armed themselves and followed him and waited for uniformed officers to intervene, I don’t believe they had any intentions to use their firearms and that’s evident from the fact that the gun is never pointed until the fight starts, but they should have stayed in the fucking truck. Them getting out and merely holding a gun doesn’t give him the right to attack them though.

You missed it, the guy in the back of the truck was the investigator, not the shooter.

The DA's report states that the two guys yelled "stop, we want to talk to you" before the scuffle broke out.

Just before the first shot you can hear some yelling in the tape. It's hard to tell what is said, but it may be just as they claim.

Its not audible but the truck stopped in the road with the two bubbas is a pretty fucking big indicator. If their intent was to execute the guy then why did they even let him get to the truck before firing, let alone flank around it? They didn’t start blasting him right away so I wonder what they could have possibly been doing? Hmmmm... It shouldn’t take too many brain cells to process that.

There were exits to both sides but he decided to go into the fight. A stupid fucking choice that cost him his life.

You don't think a real, practiced thief would have the presence of mind to NOT drop his gear and leave it all behind for the police to find and dust? You don't think a practiced thief would have a vehicle nearby to make a gettaway rather than JOG?!?

FWIW the 911 recording I just heard on the news said that they had ID’d him on video cameras. So there’s video surveillance of him doing break ins. Do you idiots saying he was murdered still thing he’s a stand up citizen out for a jog?

Assuming these videos exist and they can positively ID him then case closed. Don’t want armed people to chase you down? Then don’t fucking rob people.

Have you ever watched a single episode of cops or live PD and seen the dash cam videos of criminals tossing bags of drugs, guns, and other shit during police chases, and during foot chases? When criminals are caught they drop what they drop it and run. According to reports they armed themselves and pursued an unarmed man... yet somehow they were stopped in the street in front of him while one of the men was already in the bed of the truck. Stupidity on all participants.
 
When a “innocent victim” is in a situation like this with no means to protect themselves and has escapes, they run AWAY from the danger and scream and yell for help. That’s a fact. They don’t continue running towards the danger. The dude was fucking caught and knew he was going to jail and the only way to deal with it was overpower them.

If the slained man is on camera breaking into homes then the men that dispatched him need an award. They are neighborhood heroes. If they ambushed an innocent man then they deserve to burn. Race has no bearing. Lets wait and see.

There was, in effect, no PC (probable cause. I know this because I've watched hours of reality TV cop shows, see, skillz bitch...). Certainly, there was no PC to justify the armed pursuit.

A citizen's arrest cannot be lawful under any and all circumstances. You need a reason. Not sure you can do it with arms 'in flagrante'

But please, tell me which episode of COPS I need to rewatch to achieve your Yoda level understanding of the modus operandi of the common criminal mind...

Read the fargin report. The first shot was in his hand, coroners report says consistent with him grabbing the end of the barrel and pulling....hell read it yourselves. No one was "gunned down".

Indicating that they ID’d him as the guy. The guys a former investigator for fucks sake, he’s probably looked at enough surveillance video to know what and who he’s looking at.

Their actions were stupid, no doubt. But, I don't think any jury is going to convict them of cold blooded murder. This guy is no "jogger" innocently going about his business when he was ambushed and murdered. He was likely up to no good, got caught, and then chose confrontation instead of fleeing or just stopping and waiting for the cops to arrive. Any half assed defense attorney can make a convincing case for reasonable doubt.

More stupidity. It wasn’t in the courts for the last two months because the evidence indicated there was no wrong doing. It’s in the courts now because of the public outcry from all the pieces of shit fueling a race war, and that’s fucked up.

When they’re found not guilty they can now sue the fuck out of the state and/or local government for false arrest. There will be even more grounds for a civil judgement considering the fact that they first said there was no crime committed and are only now doing it because of the public outcry.

I don't mean bedsheet wearing racism... black people can and many are just as prejudiced as any white person, Chinese are as much as any. Prejudice is human nature. You may make a conscious effort to not be, fine, kudos, but it takes time to see enough of a person to know their character, and our minds and evolutionary history, for the sake of survival, has tuned us to make fast judgements in the meantime.
