Rifle Scopes Leupold TS-30A2 Scopes as Military surplus?

I am aware of a person selling Leupold TS-30A2 scopes in varying conditions.
Are these scopes legally available as military surplus?
If so, should the serial #'s or model #'s be obliterated?

EDITED TO ADD: The TS-30 A2 is the Marine Corps version of the Mk 4, 2.5-8 x 36mm Ill. MilDot. What separates it from the civilian version is additional etchings on the top of the tube, the 77 gr. 223 BDC M2 dial, and a keeper cable for the ill. battery cap.

I've seen people selling them on Craigslist. I'm guessing they are pilfered/souvenir bring backs. People have gotten in trouble for buying used ACOG that are mil bringbacks (they send them in for service and Trijicon keeps them as they are mil property).
