That's because being in a grade means nothing when you're the only one in it. School just happens everyday till you're 17 or 18 and it's all done.
What's way more weird is when I ask parents how old their kid is and they say 6th grade. I say that's not an age and they get stumped because apparently school age kids are completely defined by "grade".

Quick google search didn't turn up anything in NC in regards to this type of event. There’s got to be some NC cops here that may know or have received this type of call. Cant see how a judge would sign a warrant with the facts given by the school to the OP.

Just got home from work. Attorney says the principal/guidance counselor have a tampon stuck up their ass and nothing will come of it. If (in the extremely unlikely event the popo show,) call him immediately and he'll take care of it.

Do not under any circumstances consent to a search of your house unless a warrant is presented to you. Once you consent to just letting the cops in the house, you've waived your right to a search warrant and the cops can just walk around your house and there's nothing legally you can do about it from then on. Do not talk to cops. Period!

As LE, first of all…law enforcement does not enforce policies. I’ve had hospitals try to ask me for assistance to hold patients down for blood draws for their protocols regarding drug use and mental health evaluations. I tell them no.

A school policy does not circumvent the 4th amendment. Additionally, IF for some reason you wanted to give consent for cops to enter your house for this, you can revoke consent at any time. You can also limit the scope of a consent search. You could give consent to search the living room and that’s it. Unless they observed evidence of a crime from within the area you gave consent, that’s all they can do.

I can’t speak for all cops, but I don’t waste my time with nonsense. I wouldn’t even show up to your house if that was dispatched to me. I’d simply advise the school I don’t enforce school policies.

What you have on your hands is a civil matter.
 
SROs are assigned by town PD. They're regular officers and change out annually or so.

I'm hoping my attorney tells me to to send them packing. If he tells me I have to let them in I will.

Then I'll hit up Zillow and start looking for property somewhere far away with no local PD and an elected sheriff that doesn't subscribe to this gestapo bullshit. Maybe somewhere in WY, SD or OK.

Never lived in New York, but North Carolina has long been known in the southeast to tax everything, which it does…a lot…highly. Plus you have the gay ass permit to purchase a pistol. It’s almost as bad as living in California, but it’s nowhere as nice as California. Up until the newsome regime, California was much better than NC. They both tax the shit out of you, but at least California has nice weather lol.

It was easier for me to buy handguns in California than North Carolina. Better hookers too.

False. No search, except for a safety sweep, which the must be able to articulate, can be conducted without consent. Consent can be withdrawn at any time. If they refuse, and find something after you've withdrawn consent, fruit of the poisonous tree. If they see something in plain view, it must be immediately recognized as illegal. They still need a warrant, but they can have you exit while they get a warrant.

I'm glad I haven't had to deal with that kind of bullshit. Ever since I started to paint guns for a living, i've always instructed my girls to never tell anybody what I do for a living at school, not even their friends. Mine did private school for a while, and then when we moved out to the countryside they went to a public school. It's a good school, small town/farming type community of about 10K folks, so the school understands that kids are going to talk about their hunting success during deer season. They don't wig out about that. School does have a bit of a drug problem, but what high school doesn't.

I think the school is overstepping their authority (shocker), and they need to fuck right off. I'm not a lawyer, so i'm not going to be the forum lawyer and inform you of what you can or can't do. The attorney you have can do that, sounds like he's going to resolve things for you. See if he can take a few minutes to educate you and your children about their rights, and how to exercise those rights in the proper way.

Good luck, and I hope everything calms down, and I hope that the folks that got their panties in a bunch about a kid talking about a nerf gun, all go jump head first off a bridge onto a busy highway.

My public Jr. High School did that back when I was in 7th grade. Only differences was we used water balloons and the person who had to run through it was the vice principal.

I still wrestle with this regularly.

The most important life lessons I've ever learned were in the locker room and in the back of the school bus. The curriculum is easy enough to cover, but the Lord of The Flies-esque environment that exists within a public school is much harder to replace. That's where I learned to stand up for myself. It's where I learned basic business by trading snacks and selling candy. Behind every black eye and broken heart was a lesson that can't be taught out of a textbook.

To be honest, (and with no offense meant) everyone I've ever met that was homeschooled was awkward as hell. I'm about 20 minutes from the Billy Graham Library too, in the heart of the bible belt. There's no shortage of homeschooled people here. It's the social aspect of things that pushed away from homeschooling thus far.

I wish more conservatives pooled together to create private schools. I'd pay good money for that.

I feel ya man. I'm in a super red county in AL and I still don't want my kids going to public school, but I do want that social training and all that you mentioned.

I have been pushing for vouchers and more charter schools but until then, I will be sending mine to a large Christian private school. We toured it a few weeks back.

I can tell you this, there is absolutely no way in hell these idiots would be coming in my house without a warrant and then my lawyer would be here to greet them and see what else we could do to fight a bogus warrant. This is insane!( unless there is more to this story that isn't being shared)

Issue is cleared up. The SRO confirmed that the alleged “safety check” doesn’t apply here, that the school admin has no idea what they’re talking about and that the PD has no part in this. Turns out he’s a pretty cool guy and is just as annoyed with the admin as I am. He was the one that consoled my son until my wife got there and basically told the guidance counselor to BTFO.
 
But upon further reflection... it takes time and money to home-school.

So you should get that money and time from your school district by making them pay you a mimimum of $50 million dollars for violation of your child's first amendment rights. For causing pain and suffering to you and your family. For violation of your civil rights by a governmental organization attempting to search your home without due process.

I think a much longer list can me made.

And suspect that you are not the only parent affected by this. So look for a class-action suit. Send out a letter to all parents in your district asking if they or their children have had their civil rights violated by the school in ANY kind of incident like this. Doesn't have to involve guns. Kids talking about gangsta Rap? Censured for their political beliefs (or yours)? Censured or punished for a T-Shirt? In the letter, tell them to get in touch with Class-Action 'counsel.'

Once the letter goes out, you will get a ton of input from like-minded parents. And a school district will settle so fast it will make your head spin! Who knows, a good Lawyer can get very rich themselves over a suit like this.

Go for it. Need to fight back. Not with words on a forum. But in courts. And play for big bucks. Because that's what these little weasels and their commie teachers unions understand.

When my son was in 4th grade he found a lighter in a fishing boat I had just bought. He took it to school and showed it to some kids on the playground.

The school heard about it, they took my son into the principals office and called the cops. Claimed he had an explosive device at school. Cops talk to my son without me or his mother present.

When I found out I went to the school and ripped that principal a new one. Wtf is wrong with these idiots!

Peronally, Im 100% in favor of inspections for autos. Once you see some dumbass slide thru a stop sign because he had no brakes, or bald tires, or bad front end, and kill someone else, you'll know why.

HOWEVER, when does a "safety check" apply? Are you telling me that if your son was talking about hunting, or target shooting, or anything involving firearms - which are legal - then a "safety check" would be appropriate? Or your child could be suspended? That is bullshit.

If your child says, "my family has 100 firearms and I am going to kill everyone and burn this place to the ground"...ok you may have a point. Anything short if that is none of their fucking business.

And when we did have it, it was bullshit. Nobody ever pulled your wheels off and checked your brakes. They checked your lights, signals, horn, and tread depth... All the quick, easy, obvious stuff.

Even as a dumb kid I realized that $5 didn't get you much of a "public safety" inspection.

And when they talked about doing away with it, OHP warned us there would be rivers of blood on the roadways from all the unsafe vehicles.

That didn't materialize.

Sure is a lot of shitting on NC in here. 10 minutes of reading will show that schools all over the country are as funked up as ours. Certain counties are the same way when it comes to demographics, plenty of white, black and yellow trash all over.

Taxes, can't argue much on that but if I can survive, most can.

I've had my CCW since 21, haven't bought a pistol permit since. I tell everyone that plans on buying more than one gun in their life, get the CCW to make the process easy.

Vehicle inspections; having worked in major dealers, you would be happy to know I kept some real turds off the road due to failed inspections. 90% of the general public doesn't give a F about their rides, if it goes from A to B, as cheap as possible, they are happy.

Vinnie this situation sucks, I'd get back with my lawyer and see if there is an example/profit to be made of the school's retardation. I don't have any resources to help in that matter, sorry.

Im not ont to go to a place and say "We did it differently where I come from." but in Virginia the charge was $20 and they did a thorough inspection. What Ive noticed is that insurance rates are double what i psid there. Wonder why? Like anything else, it needs to be done correctly.

Drunk drivers and distracted drivers kill people too. That doesn't mean every vehicle needs an ignition interlock and a cellphone signal jammer. This wouldn't even fix the issue anyway. You could have your vehicle inspected and a month later the brakes go out. How often should inspections be? Daily, weekly, monthly, annually?

I saw an older SUV cross over the centerline by 3/4 of a car width for about a block. I thought the driver was either having a medical emergency or DUI. I stop him, and his vehicle is leaking power steering fluid. His driving conduct and the power steering actively leaking met the criteria for a vehicle per state law that "shall not be operated on a public roadway." That offense is a misdemeanor. He wanted to add more fluid to the power steering and be on his way (he lived another 20mins away on a county road with a 55mph speed limit). I told him no because he was stopped for not being able to even control his vehicle and now the steering fluid is leaking.

That's an example of a vehicle that could've been inspected and a month later now has an issue and still being driven. I've also stopped another driver for failure to maintain his lane on a major highway. He was diabetic, didn't even know what county he was in and blood sugar level above 500. He was on the verge of going into diabetic shock and likely in a ditch or head on into another vehicle. He ended up being transported to the hospital. All examples of situations that just happen regardless of what measures you take to avoid them.
