Whoa, which part is misconduct?
When they stopped doing their jobs to try and provoke a scenario that would get them a sport kill on their record.
You can hear them conspiring to work-it-out on their own recording.
Also- what does their Department SOP say about drawing? What does it say about pointing?
It would be pretty crazy if they're allowed to have three dots lined up on the forehead of the person they're trying to protect without any reason for doing so.
Then again, crazy SOPs written by inexperienced people are out there, everywhere.
A nearby-to-me jurisdiction actually bought Nighthawk 1911s and ND'd into a homeowner a few years back. The "investigation" revealed that by SOP, they were supposed to remove all safeties when talking to a suspect... and didn't say anything about positions, or where your finger was supposed to be.
The officer got off because nobody trained him not to have his finger on the trigger of a condition zero 1911 pointed at a person he is talking to. The officer lied and claimed he was "bumped by a car door," although he was nowhere near the car. He got off on an
OOPS! and sentenced to no-work, full-pay, and more range time. The family got $2M for the Victim's life.
IN THIS CASE- It only makes sense when you play the tape what they were even doing with the Victim- they weren't trying to do their jobs- which is to protect the Community- they were involved in an
attack on the Community.
They thought that they would collect a free kill off an American. Lots of guys close-to-you are driving around with the same objective... both Cops and Criminals.
TL;DR -
Don't be a Fool, Tote the Tool.
