Virginia Gun Control Updates

According to Tim Anderson of Anderson & Anderson, PC - on his Facebook video regarding HB961, the House of Delegates is set to vote on the bill on Tuesday. If it passes it will go to the Senate on Wednesday.

Went down to the General Assembly this morning to speak to Delegates and Senators. Met with several aids from both sides of the aisle. Of course all the Legislators are in committee meetings right now so all you can do is fill out guests books, leaving comments, and meet with aids, which I did. I was pleasantly surprised to have one of the Democrat's aids tell me that they were a concealed carry permit holder and if the bill passed, it would make them a felon as well. They said they had discussed that with their boss multiple times.

A few things I gathered from the conversations I had with them this morning. One, the calls and emails are there. My complaint was that I had emailed and called multiple times and I had not heard anything. They apologized and said they probably had 150 emails just over the weekend about this topic and they just didn't have the time to reply to every one of them.

I was also struck by the lack of regular people waiting to talk to reps. I was one of the only people there that wasn't in a suit. They all asked me the same question "What organization are you with?". I went to see reps that were known to be on the fence but none of them seemed interested in helping me much since I wasn't in their district. They said if I wanted to wait, I would be able to talk to an aid but they didn't know how long that would be.

My advice it to get your ass in your car or truck and drive down there today or tomorrow and talk to the people that can make a difference, whether in your district or not. It's a painless process. You walk in, go to the 3rd floor for house members (there's a list in the lobby of all the office locations you can take with you), 5th and 6th floor for Senators. You just walk around the place and there are log books and assistants outside of each office and you can sign the log book, make a comment and leave, or you can ask to speak to someone and take a seat.

You have to enter the building on the main street side. No firearms, etc.

It's really that simple and it's a big difference looking someone in the eye and speaking calmly than writing an email or leaving a voicemail.

I wasn't there 45 minutes, so it's not like it's going to take 1/2 your day.

Now go do it.
 
I need to make a slight correction, didn't speak to aids, spoke to Chief of Staff's for the reps.

And....the person I went to see yesterday, who's Chief of Staff told me he was a Concealed Carry Permit holder and he'd be a felon if this passed, voted for this nonsense. You voted to throw your own Chief of Staff under the bus? Nice. I bet you he never read the bill.

Sure there were, it had been running 55-45 on everything they picked up so 51-49 means someone didn't like it, which is actually a good sign. If they can't get all their own on board in the House, it's going to be a tougher road in the Senate because it's already been killed once in the Senate.

Mags w/ greater than 12 rounds are all gone. I will be hosting a large bonfire at my farm where we can melt down all our Magpuls ... any and all would be felons invited! BYOP however (Bring Your Own Pot).

Any word on a rally or event around the Senate decision? Will drive down if there is something organized.

my read is that yes, parts are banned for future purchase. that said, it will be pretty hard for them to prove you bought a part after the law takes effect and not before.

True. The problem is that Va based dealers can’t sell parts, and more than likely, big out of state companies won’t sell to Va residents.
 
It would be even more difficult to determine who has destroyed their standard issue magazines, especially after the sales of AR rifles increases exponentially until the law takes effect...

But let's not get ahead of ourselves just yet.

It's not listed on the judiciary committee docket for tomorrow but between emails I'm still searching... someone please post if they find out when.

I am a recent VA resident and a lot of this is new to us....but a recap as I see it. Please correct me if I am wrong.

- HB961 crossed over from House to Senate today
- Same process; read and passed to committee, two more readings
-- If passed, off to to Governor to sign into law
-- If amended, House has to agree to amendment

The Senate has 40 seats; 21 Dem, 19 Republican. It has to be a Majority to kill it, a tie will be broken by the Lt Gov and we know he will be in favor

Next Steps; WE ALL NEED to reach out to these Democrats that can potentially swing...my wife and I are heading to the capitol in the AM for a round of office calls. I expect we will see Aides and Staffers at best. But will leave A single page visual aid on how we--a professional couple, Mom, Dad, voter, competitive shooters--will become felons in 2021 if this passes.

They will temper all our outrage by saying "We changed the high capacity magazine to a misdemeanor instead of a felony, so we aren't making you all felons".

I said it yesterday. F' the emails. Get in your vehicle, drive to the building and go sit it their chairs until they see you. When you can't move in the place because it's so many 2A supporters, maybe someone will take notice.

What's happening is they are getting so many calls and emails that they don't care and they have stopped counting. They are all carrying on business like it's every other day in the General Assembly. If you know you can ignore 150 emails a day and carry on with your work, then that's what you ar going to do (and what they are doing). I can promise you, I was the ONLY person there to speak on behalf of our 2A rights when I was there. There were a few chairs that had suits in them waiting to speak to a couple of people, but the place was empty, all the people were walking around, asking each other what they did this past weekend, saying "Good morning" to various people. You aren't being heard because you aren't there.

Change that.

You don't need an appointment. You show up, ride up to the 5th and 6th floors, walk the hallways until you see the people you want to see's office, stop, ask the admin to see someone, sit in the chair and wait. There's no one else there waiting, so it's not like you are showing up to a doctor without an appointment.

I love the VCDL but it seems like they have dropped the ball at the end of the game here. A MAJOR bill passed out of the House today and neither their twitter or facebook have anything about it. They aren't sending out daily emails rallying people, they aren't pushing any other solutions. It's like they gave up and are waiting for court. They should have been, and still should be, rallying people to go to the GA and physically talk to the people. Will it make a difference? For those 4 Senators that we need 2 of, it's quite possible.

Come on VCDL, get the word out and keep us posted. Most of us have never been involved in politics at all until now. A little guidance would go a long way. Rally 50 people to show up at the 4 Senator's offices and ask for meetings. Do that every day until the vote.

yep this along with everything else is such bs. how about we don't ban all this stuff and turn us into felons or even minor criminals overnite, but instead jail the f out criminals that use firearms in the commission of their crimes.

Good catch @Not a Clue ... the "possession of a >12 rd mag as a misdmeanor"is a bait and switch to misled away from the real penalty for carrying and use. What if a victim used a >12 rd mag in an otherwise lawful self defense ? "Sir, we are sorry that violent criminal(s) attacked you, but you are now a felon. Welcome to VADOC."

And IIRC, a class 1 misdemeanor can still carry up to a year in jail.

HB 961, the "assault weapon, higher-capacity magazine, and suppressor ban bill squeaked out of the House on a 51 to 48 vote. While killing the bill would have been the best outcome, this is second best. It passed on a partisan vote, but was opposed in a bipartisan vote (Democrat Delegates Carter, Heretick, and Tyler broke ranks and opposed the bill. That is a perfect record for Tyler.

That weak vote strengthens our belief that the bill can be killed in the Senate if we put enough effort into doing so!

The bill was modified from its original form. As passed by the House, the bill allows a person to keep their existing "assault firearm" (without registering it) and suppressor, but cannot buy any new ones and may not be able to repair the assault firearm. Magazines that hold more than 12 rounds and bump stocks would need to be destroyed or removed from the Commonwealth by 1/1/2021.

I am local law enforcement officer and have been for the last 15 years. The bill you are about to vote on is not about gun violence. Bad people exist in this world. Bad people will always exist in this world. Restricting the rights of others by not allowing them to carry tools for their own personal protection does a disservice to good law-abiding people. I am in business of dealing with criminals. Criminals are people who commit crimes and who do not obey the law regardless of what it says. For your viewing pleasure, I have included an Excel spreadsheet from the last 5 years on violent crime. This is not my spreadsheet. This came directly from the FBI and is reported crime by all law enforcement agencies in the United States.

As you can see there are more homicides committed with knives, blunt objects, and personal weapons (hands, fists, feet) than are committed with so called “assault rifles”. These rifles have been around since the late 1940s to 1960s and banning them will only promote violent crime as law abiding people will not have these weapons for self-defense should they be banned. A “high capacity” magazine ban will also be ineffective and again only seeks to punish the law abiding who have these items, yet do not use them irresponsibly. Improper use of vehicles kills far more people than firearms in this country, yet no one is lining up to ban them.



Punish the criminals. If you are interested in really putting a dent in violent crime I encourage you to put stiffer penalties on these very criminals committing violent crimes without paroling them. We have enough laws on our books. I, as law enforcement enforce these laws, but our very government that I work for releases these violent criminals or, at a minimum, slaps them on the wrist and sends them right back out in the public. I have personally talked to criminals I have arrested and have little to no fear of being charged because they know they will get time off for good behavior or get paroled early. They aren’t being held accountable for their actions and good people who don’t commit these crimes are being punished for being law abiding. Seems backwards to me. I like any other law-abiding Virginian have never committed a crime and yet I am being punished for the actions of others.



Finally, I own at least 1 of each item on this bill that should you vote to ban will turn me into a felon on July 1 2020. The firearms I currently carry on duty is on that list. Does that make any good sense to you? You may say “Oh since your law enforcement, you can keep those items.”

With all due respect, I don’t want your special treatment. If the average law-abiding citizens can’t be trusted to have these items, then what makes you think I am any different? I am a Virginia citizen first and foremost and I absolutely against making two classes of citizens. Law abiding citizens are on my side. When I put my uniform on I am honored to serve them. I am no way better than they are and we in law enforcement don’t deserve any different treatment or special exceptions to be made. That kind of thinking/treatment breeds distrust among our citizens and frankly you don’t have to deal with it. Law enforcement does.

I will tell you this and you may take it for what it is. When people are compelled to do something, they will either submit or rebel. Based on what I am seeing out in the public is this. People are fed up with having their rights trampled on. They will not forget the way you voted on this unconstitutional bill and should you vote to restrict Virginians God-given rights, I as a law enforcement officer will stay loyal to my oath to support and defend the constitution of these United States above any laws you pass.



In closing, again, I urge you to vote “No” for HB 961. Thanks for your time.

HB899 -Restricted firearm ammunition

Manufacture, import, sale, transfer, or possession of restricted firearm ammunition; penalty. Makes it a Class 5 felony to manufacture, import, sell, transfer, or possess any restricted firearm ammunition, defined in current law as bullets, projectiles, or other types of ammunition that are (i) Teflon coated or coated with a similar product; (ii) commonly known as "KTW" bullets or "French Arcanes"; or (iii) cartridges containing bullets coated with a plastic substance with other than lead or lead alloy cores, jacketed bullets with other than lead or lead alloy cores, or cartridges of which the bullet itself is wholly composed of a metal or metal alloy other than lead, but the definition does not include shotgun shells or solid plastic bullets. The bill provides exceptions to the prohibition and provides that any restricted ammunition possessed in violation of the law shall be forfeited to the Commonwealth.
